Law No. (4) of 2023 On Prohibiting Single-Use Plastic Items in Emirate of Ras Al Khaimah
We, Saud Bin Saqr Bin Mohamed Al Qasimi Ruler of Ras Al Khaimah
After perusal of the Constitution;
And Federal Law No. 24 of 1999 on Protecting & Developing Environment;
And Law No. 2 of 2007 on Establishing Environment Protection & Development Authority in Ras Al Khaimah, as amended;
And Law No. 7 of 2012 on Establishing Executive Council in Ras Al Khaimah;
And after approval of the Executive Council;
promulgated the following Law:
Article (1)
In applying the provisions of this Law, the following words and phrases shall have the meanings corresponding to each of them respectively, unless context otherwise requires:
Emirate: Emirate of Ras Al Khaimah
Authority: Environment Protection and Development Authority
President: Authority President
Director General: Authority Director-General
Concerned Authorities: All Government Departments & Authorities
Single-Use Plastic Items: Plastics Not Designed for Multi Uses
Article (2)
The provisions of this law shall apply to entire territory of the Emirate including Ras Al Khaimah Economic Zones and the Executive Council may, upon request of the Authority, exclude specific authorities from provisions thereof.
Article (3)
It is prohibited to bring, hold, trade, sell or use single-use plastic items in the Emirate.
Director-General shall, in coordination with concerned authorities, prepare the necessary plan to implement prohibition on phases ending by beginning of 2024 and the same shall be presented to the President for approval.
All authorities and ports shall regularize their positions in accordance with prohibition implementation plan and resolutions and instructions issued to implement the same.
Article (4)
The following shall be excluded from the prohibition stated in article (3):
1- Products prepared for export or re-export abroad.
2- Single-use bags and products manufactured from materials that are recycled in the Emirate according to the manual issued by Ministry of Climate Change & Environment.
3- Other products and items determined and
excluded by resolution from Director-General in coordination with Ministry and concerned authorities.
Article (5)
The Authority shall, in coordination with concerned authorities, undertake the following:
1- Prepare awareness & informative programs on importance of transition from single-use plastic items to consuming other environmental friendly and multi-use alternatives.
2- Coordinate with authorities concerned with preparing appropriate incentives system to encourage importing, producing and manufacturing safe and eco-friendly alternatives for single-use plastic items.
3- Present quarterly report to Authority’s President on its achievements in implementing prohibition plan and challenges which it is facing and appropriate solutions to overcome them.
Article (6)
The giant and medium outlets of consumer goods shall commit to develop an incentive system for their customers to use and promote alternatives of single-use plastic items.
Article (7)
The Executive Council of the Emirate shall, upon proposal of the Authority, issue resolution to impose charges on some single-use plastic products whose proceeds shall be allocated to support the gradual transition to alternatives thereof.
Article (8)
The employees of the Authority, named by resolution from the Authority President, shall be empowered with capacity of law officer in proving acts violating the provisions of this law and resolutions issued in implementation thereof.
Article (9)
Without prejudice to any more severe punishment stipulated by other law, a fine of not less than one thousand dirham and not exceeding five thousand dirham shall be imposed on anyone violated the provisions of this law or any of the resolutions or circulars issued in implementation thereof and this penalty shall be doubled in case of repeating the same violation within six months from the date of committing the previous violation.
Any of the following measures may be imposed on the facility:
1- Warning
2- Suspend the license of practicing the activity for a period not exceeding one year.
3- Cancel the license.
Article (10)
In order to implement the provisions of this law, resolutions and circulars issued in implementation thereof, the Authority is entitled to coordinate with the concerned authorities and seek the assistance thereof.
Article (11)
The President or his representative shall issue the necessary resolutions to implement the provisions of this law.
Article (12)
This Law shall come into force as date of its issuance and be published in the Official Gazette.
