Executive Council Resolution no. (8) of 2024 On Regulating Using Jet Skis In Ras Al Khaimah Emirate We, Mohamed Bin Saud Bin Saqr Al Qasimi Crown Prince & President of Executive Council After perusal of Federal Law No. (3) of 1971 on Federal Armed Forces, as amended; And Federal Law No. (12) of 1976 on Police & Security Force, as amended; And Federal Decree-Law No. (38) of 2022 on Promulgating Criminal Procedures Law, as amended; And Federal Decree-Law No. (43) of 2023 on Maritime Law; And Law No. (2) of 2007 on Establishing Environment Protection & Development Authority in Ras Al Khaimah; And Law No. (7) of 2012 on Establishing Ras Al Khaimah Executive Council; And Law No. (3) of 2015 on Law of Technical Systems for Establishments Security, as amended; And Law No. (8) of 2016 on Regulating Practicing Economic Activities in Emirate of Ras Al Khaimah; And Law No. (13) of 2023 on Licensing and Operating Maritime Means in Ras Al Khaimah Emirate; And Emiri Decree No. (1) of 2008 on Ras Al Khaimah Transport Authority; And Resolution No. (9) of 2020 on Organizing Events in Emirate of Ras Al Khaimah; And based on approval of the Executive Council; promulgated the following Resolution: Article (1) In applying provisions of this resolution, the following words and phrases shall have the meanings corresponding to each of them respectively, unless context otherwise requires: State: United Arab Emirates. Emirate: Emirate of Ras Al Khaimah. Council: Executive Council of the Emirate. Authority: Ras Al Khaimah Transport Authority. Police: Ras Al Kaimah Police General Headquarters. Director-General: Director-General of the Authority. Concerned Authorities: Border Guards, Ras Al Kaimah Police General Headquarters, Public Services Department, Ras Al Khaimah Ports, Environment Protection & Development Authority in Ras Al Khaimah, Tourism Development Authority in Ras Al Khaimah, Ras Al Khaimah International Marine Sports Club and any authority related to application of this resolution provisions. Jet Ski: Jet ski operated by a motor. Operating Area: The geographical scope where jet skis are authorized to operate therein. Waters of the Emirate: Water located within the maritime borders of the Emirate, lakes and internal water channels. Slipway: location designated to land jet skis into water according to the locations approved by the Authority. Positioning Device: A device operates by technical system that specifies accurately the jet ski location and places where it sailed within waters of the emirate. Instructor: A qualified and specialized individual providing knowledge and necessary skills for individuals who are working in one or more of the various maritime fields. Register: Register of recording jet skis and individuals associated thereto. Prohibited Places: Areas where it is prohibited to carry out any of jet skis activities according to controls and promulgated legislation. Maritime Accident: Any accident that could endanger safety of jet ski, slipway, individuals, property or environment. Article (2) The provisions of law no. (13) of 2023 on Licensing and Operating Maritime Means in Ras Al Khaimah Emirate shall apply to whatever not stipulated in this Resolution. Article (3) By decision from Director-General and in coordination with competent authorities, each with competence thereof, areas of jet skis slipway and operation and times in which it is permitted to use them shall be determined. The Director-General or whom he authorized may prevent using jet skis in unsuitable weather conditions announced by warning bulletin to be issued by the competent meteorology authority. Article (4) It is prohibited to use jet skis in the emirate except after obtaining license for this from the Authority, except: 1- Jet skis owned by Armed Forces, Police, Civil Defense or Ras Al Khaimah Ports. 2- Jet skis licensed outside the emirate and permitted by the Authority to enter waters of the emirate provided presenting an insurance policy that is valid throughout validity period of the permit and issued by an insurance company licensed to operate in the State or any other authority approved by the Authority. 3- Jet skis to be determined by resolution from Director-General. Article (5) Jet ski license application shall be presented to the Authority on the form prepared for this, attached with copies of the following documents: 1- Title deed of the jet ski to be licensed. 2- Customs clearance certificate for jet ski imported from abroad. 3- Applicant identity verification document. If applicant is legal person, copy of the trade license thereof should be attached. 4- Valid certificate issued by the Authority or any other authority approved thereby, proving that the jet ski has passed the technical inspection. 5- Jet ski insurance policy that is valid throughout validity period of the license and issued by an insurance company licensed to operate in the State or any other entity approved by the Authority. 6- Any other document required by the Authority under resolutions and instructions issued thereby in this regard. Article (6) Jet ski shall not be licensed or used unless it is in good mechanical condition and meets the following technical requirements: 1- To be in conformity with UAE standard specifications. 2- Its engine shall be four-stroke one at least with the exception of two-stroke engines used currently provided that license thereof shall be cancelled within three years or period determined by the Environment Protection and Development Authority, whichever is less . 3- It shall be equipped with automatic extinguishing system or fire extinguisher with exception of jet skis that the system is not provided thereto or cannot technically be equipped with fire extinguisher and such exception shall be for three years from the date of promulgating this Resolution. 4- Availability of globally approved life jacket for each user. 5- Presence of hull number for the jet ski. 6- Equipped with suitable shock protection means and flame traps on air filter. 7- Its battery shall be sealed type and serviceable. 8- Availability of suitable cover around push machine. 9- Equipped with convenient steering system to control all floating positions. 10- Those designed for reverse movement shall be equipped with Detach System. 11- Gear lever shall be designed for automatic return to normal position. 12- Intactness of fuel tank, supplying pipes and its meter. 13- Install jet ski positioning system approved by the Authority. 14- Any other conditions determined under resolutions and instructions issued by the Authority. Article (7) It is prohibited to make any modifications that may affect the technical specifications of the jet ski except by special permit from the Authority which may, after issuing the license, inspect the jet ski at any time and compel its owner to implement instructions issued thereby based on findings of the inspection and he should re-inspect it otherwise the Authority may withdraw or cancel the jet ski license. Article (8) In order for the facility to obtain license to carry out jet ski rental activity, the following conditions should be met: 1- Get trade license to practice jet ski rental activity. 2- It shall be member in Ras Al Khaimah Chamber of Commerce. 3- Provide copy of UAE Identification Card of company owner and partners therein. If any of them is not UAE citizen, he should present copy of his passport. 4- Provide insurance policy for each jet ski that shall be valid throughout validity period of the license and issued by an insurance company licensed to operate in the State or any other authority approved by the Authority. 5- Availability of licensed and specialized instructor in using jet ski in addition to presence of Operation Controller and lifeboat along with crew thereof to be used when necessary in rental places. 6- Availability of protection and safety devices and equipment and first aid in rental places. 7- Approval of the authority which the company wishes to carry out the activity within water borders thereof. 8- Any other conditions determined under resolutions and instructions issued by the Authority. Article (9) In carrying out its activity, jet ski rental offices shall commit to the following: 1- Maintain the following registers: a- A register to record names of employees working therewith, nature of their work and all information necessary to verify their identity and places of residence. b- A register to record data and information of jet skis owned by the facility, particularly their numbers, types, year of manufacturing, hulls and engines numbers and insurance policies. c- Periodical maintenance register for each jet ski. d- A register to record details and information of jet skis’ renters, particularly their names, nationalities, ages, time, date and duration of renting jet skis. 2- Provide jet skis’ users with necessary information on how to use and operate jet skis, borders of areas in which it is permitted to carry out the activity and the prohibited areas. 3- Availability of protective and safety devices and equipment and first aid in rental locations and compel renters of jet skis to wear life jackets and shock – proof helmets. 4- Obligate jet skis renters before receiving them to fill out and sign general conditions form prepared according to the form approved by the Authority for this purpose. 5- Not to conduct any maintenance or repair jet skis in locations of carrying out the activity or on the beach and commit to move the same to locations permitted for this purpose. 6- Commit to the terms of storing fuel and refueling approved by Civil Defense Administration. 7- Not to allow those who are under sixteen years old to use jet ski unless accompanied by guardian or qualified instructor, provided that motor power shall not exceed 1200 CC. 8- Not to allow those who are above sixteen years old and not passing eighteen years old to rent jet ski except by approval of the guardian, provided that motor power shall not exceed 1200 CC. 9- Renter shall be mentally and physically sound to be qualified to ride the jet ski. 10- Renter shall be familiar with rules of operating and using the jet ski and acting in emergency circumstances. 11- Ascertain the technical suitability of the jet ski for operation and equipped the same with necessary safety means before renting it. 12- The jet ski shall carry a plate of its registration number and a sticker shall be placed thereon according to specifications determined by the Authority. 13- Land jet ski into water from the place designated for this, taking into account utmost level of care and caution when starting up. 14- Maintain hygiene of places designated to carry out the activity and prevent leakage of oils or fuel therein or dispose of any liquid or solid wastes harmful to environment in places not designated for that. 15- Refuel jet skis in places designated for that. 16- Usage and rental of jet ski shall be after sunrise till sunset and in appropriate weather conditions. 17- Not to load the jet ski with more persons than the number permitted in license thereof. 18- Notify the Authority of jet skis that disappeared from operating area and did not return back after expiry of rental period. 19- Keep copy of the trade license issued thereto, as well as title deeds of jet skis owned by the facility and any other documents the authority deems related ones and present the same upon each request. 20- Any other conditions determined by resolutions and instructions issued by the Authority. Article (10) a- Places of using jet ski in the marine zone designated therefor shall be determined from last point of swimming and for the following distances within seawater: 1- Distance of sixty meters from places designated for swimming or any fixed or floating structure, particularly anchored ships, boat slipway, berths, moorings, rafts or other water flotels, except navigation aids. 2- Distance of one hundred meters away from any vessel or afloat on which the flag – Diver Below - is raised “Alpha symbol that is represented internationally by white and blue flag and letter (A) printed in English”. 3- Distance of three meters deep vertically to the coast, water edge, residential areas, borders of areas designated for swimming or diving, boat slipway, marine reserve areas, maritime borders of Ras Al Khaimah ports, military bases or ferries routes. 4- A distance not less than fifty meters from bridges. 5- In all cases, the distance of practicing maritime activities shall not exceed one nautical mile from the coast towards open water except by special permit. b- Users of jet skis should drive them at a speed not exceeding five knots. c- Parking and departure places of jet skis used for commercial purposes shall be located on floating platforms inside sea water or on shore in locations approved by the Authority after availability of safe passage for launching and if jet skis are not designated for commercial purposes, they depart and return from maritime clubs or places approved by the Authority. d- The Authority may change maritime areas allocated to carry out activity of using and renting jet skis and create new areas in coordination with concerned authorities. e- Places of jet skis parking and departure and return platforms and areas approved by the Authority should be adhered thereto. Article (11) In order to obtain a temporary permit to organize maritime races, the following conditions should be met: 1- Considering weather condition and warning bulletins from competent meteorology authority before starting the races and during their course and stop the same in the event of sudden change of weather that may affect negatively safety of maritime navigation and participants in the races. 2- Provide written approval from the authority which the race area falls with water borders thereof. 3- Coordinate with the concerned authorities in the emirate. 4- Organize races in the specified operation area and on times stated in the permit. 5- Provide a certificate proving that jet ski had entered through one of the competent authorities in the State. 6- The jet ski shall conform to the UAE standard specifications. 7- Availability of globally approved life jacket and shock – proof helmet for each user. 8- Obtain insurance policy for the jet ski from one of the insurance companies operating in the State or abroad that covers the geographical area in which the race is taking place. 9- Not to take any action that may affect the navigation safety for the jet skis participating in the race. 10- Notify each of the Authority and Police immediately of occurrence of any maritime accident and provide it with the report issued by the competent authority on the nature and reasons of the maritime accident and procedures taken to address effects thereof. 11- Remove any barriers, maritime flotels, signs or debris from races area immediately after they ended. And in case races took place as or on occasion of events, the authority organizing the event should obtain permit for the event through Event Electronic System. Article (12) Upon operating and sailing, user of jet ski shall adhere to the following safety instructions and directions: 1- Stay away from borders of locations and places designated for swimming and areas assigned to hotels on the beaches and sea lines designated for vessels and other maritime means passage and anchoring places thereof. 2- Ride the jet ski carefully and act during riding seriously and not cause harassment or endanger others. 3- Not to approach territorial water borders except if there is permit to do so. 4- Notify the Authority of any accidents or risks related to safety or maritime environment pollution by any means of communication. 5- Adhere to number of persons permitted to embark the jet ski. 6- Not to use jet skis in places in which it is prohibited to practice the activity or in fishery and fishing marine organisms. 7- Report any maritime collision accident resulted in injuries or halt jet ski even if it is not party therein. 8- Any other instructions or directions issued by the Authority in application of this Resolution provisions. Article (13) It is prohibited to ride or attempt to ride jet ski while being under influence of alcoholic beverages, narcotic substances. It is also prohibited to stay overnight in jet ski rental locations. Article (14) 1- Fees, violations and measures schedules attached hereto shall be approved and proceed of fees and fines shall devolve upon the Authority. 2- Without prejudice to any more severe penalty stipulated by any other legislation, each one violates the provisions of this law shall be subject to fines and measures stipulated in the two schedules attached thereto. 3- The Authority may reconcile violations stipulated in the two schedules attached hereto and left attachment on jet ski after removing violation reasons and payment of one third of the prescribed value of the violation and in case violator did not accept reconciliation, the papers shall be referred to Public Prosecution and in the event of conviction, the fine should not be less than the maximum prescribed limit thereof. Article (15) Employees and inspectors of the Authority nominated by resolution from Director- General shall be granted law officers’ capacity in proving acts committed in violation of provisions of this Resolution, make necessary reports, seize and impound jet skis in case of committing violations that require that and they may, in particular, do the following: 1- Inspect all jet skis, their users, places of shelters, departure and operations areas to ensure they obtained the prescribed licenses and permits and commit to conditions and limits thereof. 2- Ensure that jet skis users and rental offices follow security and safety procedures, environmental standards and requirements and adhere to borders of operation areas and points of departure and return. 3- Receive notifications and complaints regarding riding jet skis in a condition that endangers property and individuals or makes annoying sounds or emits dense smoke or exhaust not complying with environmental requirements. Article (16) Police, in coordination with the Authority, shall: 1- Receive proclamations and complaints regarding maritime accidents and crimes committed in marine areas. 2- Combat and prevent acts that constitute crimes in maritime areas, arrest their perpetrators in case of occurrence thereof and collect evidences leading to their conviction. 3- Provide support to the Authority in dispersing any un-permitted races in the event competitors did not comply with order of the Authority to disperse the race after warning them by possible ways. 4- Implement laws, regulations and procedures which the Authority is entrusted to implement. Article (17) Without prejudice to competences of concerned authorities, Residential Complex, Developers & Hotels Administration shall undertake the following: 1- Guard its water borders and control the same by all available means therewith in coordination with concerned authorities. 2- Place informative signs determining swimming locations, its jet skis departure points, departure path thereof to operation areas and borders thereof. 3- Comply with instructions and decisions issued by the Authority in implementation of this Resolution provisions. 4- Report to the police immediately any acts that constitute maritime crimes or accidents. 5- Inform the Authority of any violation to provisions of this Resolution occurred in the waterfront thereof, particularly riding jet skis in a condition that results in danger to individuals, damage to property, emits dense smoke or makes annoying sounds. Article (18) The jet ski shall be impounded by riding, towing or moving it by owner or rider thereof to the place determined by the Authority, otherwise the Authority shall do this itself or with assistance of one of the authorized entities at the expense of jet ski owner and shall not be handed over to owner thereof except the reason of impoundment shall not exist anymore and after payment of all fees and fines as well as expenses resulted from the impoundment thereof. Article (19) The concerned authorities, each according its competence, must coordinate with the Authority and provide support in implementing provisions of this Resolution. Article (20) This Resolution shall come into force as date of its promulgation and be published in the Official Gazette.   • The provisions of law no. (13) of 2023 on Licensing and Operating Maritime Means in Ras Al Khaimah Emirate shall apply to whatever not stipulated in this Resolution.

  • In carrying out its activity, jet ski rental offices shall commit to the following:

    3- Distance of three meters deep vertically to the coast, water edge, residential areas, borders of areas designated for swimming or diving, boat slipway, marine reserve areas, maritime borders of Ras Al Khaimah ports, military bases or ferries routes. 
    4- A distance not less than fifty meters from bridges. 
    5- In all cases, the distance of practicing maritime activities shall not exceed one nautical mile from the coast towards open water except by special permit. 
    b- Users of jet skis should drive them at a speed not exceeding five knots.  
    c- Parking and departure places of jet skis used for commercial purposes shall be located on floating platforms inside sea water or on shore in locations approved by the Authority after availability of safe passage for launching and if jet skis are not designated for commercial purposes, they depart and return from maritime clubs or places approved by the Authority.  
    d- The Authority may change maritime areas allocated to carry out activity of using and renting jet skis and create new areas in coordination with concerned authorities. 
    e- Places of jet skis parking and departure and return platforms and areas approved by the Authority should be adhered thereto.  

     
  • In order to obtain a temporary permit to organize maritime races, the following conditions should be met: 
    1- Considering weather condition and warning bulletins from competent meteorology authority before starting the races and during their course and stop the same in the event of sudden change of weather that may affect negatively safety of maritime navigation and participants in the races.  
    2- Provide written approval from the authority which the race area falls with water borders thereof.  
    3- Coordinate with the concerned authorities in the emirate. 
    4- Organize races in the specified operation area and on times stated in the permit. 
    5- Provide a certificate proving that jet ski had entered through one of the competent authorities in the State.  
    6- The jet ski shall conform to the UAE standard specifications. 
    7- Availability of globally approved life jacket and shock – proof helmet for each user. 
    8- Obtain insurance policy for the jet ski from one of the insurance companies operating in the State or abroad that covers the geographical area in which the race is taking place. 
    9- Not to take any action that may affect the navigation safety for the jet skis participating in the race. 
    10- Notify each of the Authority and Police immediately of occurrence of any maritime accident and provide it with the report issued by the competent authority on the nature and reasons of the maritime accident and procedures taken to address effects thereof. 
    11- Remove any barriers, maritime flotels, signs or debris from races area immediately after they ended. 
    And in case races took place as or on occasion of events, the authority organizing the event should obtain permit for the event through Event Electronic System. 

  • Upon operating and sailing, user of jet ski shall adhere to the following safety instructions and directions: 
    1- Stay away from borders of locations and places designated for swimming and areas assigned to hotels on the beaches and sea lines designated for vessels and other maritime means passage and anchoring places thereof. 
    2- Ride the jet ski carefully and act during riding seriously and not cause harassment or endanger others.   
    3- Not to approach territorial water borders except if there is permit to do so. 
    4- Notify the Authority of any accidents or risks related to safety or maritime environment pollution by any means of communication. 
    5- Adhere to number of persons permitted to embark the jet ski.
    6- Not to use jet skis in places in which it is prohibited to practice the activity or in fishery and fishing marine organisms.
    7- Report any maritime collision accident resulted in injuries or halt jet ski even if it is not party therein. 
    8- Any other instructions or directions issued by the Authority in application of this Resolution provisions. 

     
  • It is prohibited to ride or attempt to ride jet ski while being under influence of alcoholic beverages, narcotic substances. It is also prohibited to stay overnight in jet ski rental locations.

     
  • 1- Fees, violations and measures schedules attached hereto shall be approved and proceed of fees and fines shall devolve upon the Authority. 
    2- Without prejudice to any more severe penalty stipulated by any other legislation, each one violates the provisions of this law shall be subject to fines and measures stipulated in the two schedules attached thereto.   
    3- The Authority may reconcile violations stipulated in the two schedules attached hereto and left attachment on jet ski after removing violation reasons and payment of one third of the prescribed value of the violation and in case violator did not accept reconciliation, the papers shall be referred to Public Prosecution and in the event of conviction, the fine should not be less than the maximum prescribed limit thereof. 

     
  • Employees and inspectors of the Authority nominated by resolution from Director- General shall be granted law officers’ capacity in proving acts committed in violation of provisions of this Resolution, make necessary reports, seize and impound jet skis in case of committing violations that require that and they may, in particular, do the following: 
    1- Inspect all jet skis, their users, places of shelters, departure and operations areas to ensure they obtained the prescribed licenses and permits and commit to conditions and limits thereof. 
    2- Ensure that jet skis users and rental offices follow security and safety procedures, environmental standards and requirements and adhere to borders of operation areas and points of departure and return. 
    3- Receive notifications and complaints regarding riding jet skis in a condition that endangers property and individuals or makes annoying sounds or emits dense smoke or exhaust not complying with environmental requirements.  

     
  • Police, in coordination with the Authority, shall: 
    1- Receive proclamations and complaints regarding maritime accidents and crimes committed in marine areas. 
    2- Combat and prevent acts that constitute crimes in maritime areas, arrest their perpetrators in case of occurrence thereof and collect evidences leading to their conviction. 
    3- Provide support to the Authority in dispersing any un-permitted races in the event competitors did not comply with order of the Authority to disperse the race after warning them by possible ways. 
    4- Implement laws, regulations and procedures which the Authority is entrusted to implement. 

     
  • Without prejudice to competences of concerned authorities, Residential Complex, Developers & Hotels Administration shall undertake the following:  
    1- Guard its water borders and control the same by all available means therewith in coordination with concerned authorities.
    2- Place informative signs determining swimming locations, its jet skis departure points, departure path thereof to operation areas and borders thereof.
    3- Comply with instructions and decisions issued by the Authority in implementation of this Resolution provisions. 
    4- Report to the police immediately any acts that constitute maritime crimes or accidents. 
    5- Inform the Authority of any violation to provisions of this Resolution occurred in the waterfront thereof, particularly riding jet skis in a condition that results in danger to individuals, damage to property, emits dense smoke or makes annoying sounds. 

     
  • The jet ski shall be impounded by riding, towing or moving it by owner or rider thereof to the place determined by the Authority, otherwise the Authority shall do this itself or with assistance of one of the authorized entities at the expense of jet ski owner and shall not be handed over to owner thereof except the reason of impoundment shall not exist anymore and after payment of all fees and fines as well as expenses resulted from the impoundment thereof.  

     
  • The concerned authorities, each according its competence, must coordinate with the Authority and provide support in implementing provisions of this Resolution.

     
  • This Resolution shall come into force as date of its promulgation and be published in the Official Gazette.
