Law No (1) of 2012 Promulgated on Organizing Department of Civil Aviation in Ras Al Khaimah Emirate (This Law had been amended by Law (2) of 2014, Law (4) of 2014 and Law (1) of 2017) We, Saud Bin Saqr Bin Muhammed Al Qasimi Ruler of Ras Al Khaimah After perusal of Federal Law No. (20) of 1991 on Promulgating Civil Aviation Law, And Federal Law No. (4) of 1996 on General Civil Aviation Authority, And Emiri Decree No. (18) of 2006 on Approving Procedures to Establish Department of Civil Aviation in Ras Al Khaimah. have promulgated the following law: Article 1 Definitions stated in Federal Law No. (20) of 1991 on Promulgating Federal Civil Aviation Law, as amended shall be applicable. However, for the purposes of this Law, the following words and phrases shall have the meanings assigned hereto respectively, unless the context requires otherwise: Emirate: Emirate of Ras Al Khaimah. Ruler: His Highness Ruler of the Emirate. Department: Department of Civil Aviation in the Emirate President: The President of Department. Airport: Ras Al Khaimah International Airport. Competent Authority: General Civil Aviation Authority. Other Authorities: Authorities which the Department deems it is necessary to coordinate therewith. Aircraft: Any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth’s surface including all aircrafts such as airships that use fixed and rotary wings and others intended for civil purposes. Article 2 Civil Aviation Department shall have an administratively independent legal personality, independent balance sheet and legal capacity necessary to undertake all acts and actions that ensure achieving objectives thereof. Article 3 Department is the concerned local authority and it represents the Emirate before General Civil Aviation Authority and other authorities related to civil aviation affairs. To this end, the Department shall be entrusted with the following: 1- Supervise civil aviation and organize its affairs in the Emirate pursuant to what Federal Law No. (20) of 1991, as amended and International Civil Aviation Regulations stipulate, in order to maintain safety of aviation and air navigation. 2- Supervise the airport administratively and technically to ensure that operations, maintenance and development thereof are conducted according to relevant federal and local laws, rules and regulations. 3- After ensuring the financial, administrative and technical capabilities of the companies, the Department shall do the following: A- Provide approval to competent authorities concerned with issuing licenses to carry out the activities of travel, freight and unloading agencies. B- Provide initial approval on issuing licenses to carry out activities related to civil aviation, aircrafts maintenance, aircraft spare parts, navigation devices and airport equipment trading. C- Provide approval to issue licenses for any company wishing to work through Ras Al Khaimah International Airport in one of the activities related to airports. 4- Represent the Emirate in Arab and international conferences relevant to civil aviation according to regulations in force. 5- Propose local fees and taxes in consideration of services provided by the Department such as aircraft landing, sheltering and departing and collecting these fees subject to Federal Civil Aviation Law. 6- Prior license to establish, operate or invest in airports and airstrips in the Emirate subject to applicable regulations and systems with General Civil Aviation Authority. However, Department shall set rules and conditions to issue licenses for establishing and operating airports and airstrips subject to payment of determined fees. 7- Facilitate works of Investigation Committees in aircraft accidents by the competent authority in the State, in accordance with Federal Civil Aviation Law provisions and support audit processes conducted by the competent authority. 8- The Department shall supervise all personnel working in the airport in safety and security field and ensure the integrity of measures that guarantee non-prejudice of security of the airport area and workflow therein. To this end, it shall investigate direct violations to take the necessary procedures in cooperation with other authorities. 9- The Department shall create special easements to secure the safety of air navigation and proper functioning of the equipment related thereto, including the following: A- Prevent building or removing any buildings, constructions or any obstacle whatever kind thereof in the areas adjacent to the airport and air navigation facilities except by approval of the Department. B- Prevent cabling or wiring of any kind. C- Guide to obstacles that jeopardize the safety of air navigation. 10- No obstacle or building may be constructed within the area included as easements nor making any change to the nature of lands except by prior authorization from the Department and as per the determined conditions. However, the Department shall have the right to remove any facilities in these areas which might be constructed without permit, if needed in coordination with Municipality Department. 11- It is not permissible to install any lighting beacon or fireworks that may affect air traffic except after approval of the Department. 12- The Department, jointly with other authorities, shall supervise applying regulations and instructions and take procedures which it deems necessary to maintain security and ensure safety and handling of aircrafts and navigation equipment. To this end, the Department shall: A- Drive away, restrict or prevent access of individuals and equipment to some areas in the airport. B- Verify the identity of individuals and vehicles that access the airport and monitor, interrogate, and inspect them if needed. C- Inspect any individual suspected of carrying weapons or flammable substances that may be used in acts of sabotage and threats during the flight. 13- The following aircrafts shall be exempted from the previously mentioned fees: - Federal Air Force aircrafts. - Emiri Flight. - Aircrafts used free of charge in ambulance and rescue, Red Crescent and Red Cross aircrafts. - Any other aircrafts the Department decides to exempt after obtaining the necessary approval from higher authorities. 14- Issue permits to access the restricted area in the airport for individuals, vehicles and equipment. However, Department has the right to cancel any permit without prior notice. 15- Provide private permits for putting up a poster, signboard or informational board in the areas belonging to the airport campus. 16- Implement Laws and regulations promulgated from the Competent Authority regarding issuance of licenses, operating certificates, operating standards and specifications or transport rights and bilateral agreements. Article 4 The airport shall have height rights zones determined by the Department in accordance with provisions, international agreements and the Competent Authority in this field. The objective thereof is to ensure the safety of air navigation and proper functioning of its devices. Article 5 The President shall manage, conduct the business of and represent the Department before all official authorities and shall be nominated under an Emiri Decree to be promulgated by the Ruler or his representative. Article 6 The Department shall be responsible for developing the general policy it follows, approve the plans that govern workflow, make decisions that ensure achieving its objectives and coordinate the activities of various sectors. To this end, it shall: 1- Develop general policy and approve plans and work programs. 2- Set the regulations necessary to regulate the work in the Department including the regulations related to the administrative, financial and technical affairs of the Department. 3- Set and collect fees and rents that Department collects in consideration of the services provided thereby. 4- Open and manage the financial accounts of the Department. 5- Cooperate and coordinate with federal and Local government authorities regarding civil aviation affairs. 6- Negotiate with airlines, travel and cargo agencies, grant the necessary facilities and act as a link between them and the government in a manner that does not contradict with applicable laws in the State. 7- Record and count the movement of transportation in the Emirate, including passengers, cargo, etc. Article 7 This Law shall come into force from the date of its promulgation and shall be published in the Official Gazette.   • This Law shall come into force from the date of its promulgation and shall be published in the Official Gazette.
