Resolution No. (11) of 2014 On Striking off, Disassembling and Recycling Aircrafts We, Saud Bin Saqr Bin Mohamed Al Qasimi Ruler of Ras Al Khaimah After perusal of Federal Law No. (20) of 1991 on Promulgating Civil Aviation Law ; And Federal Law No. (4) of 1996 on Establishing General Authority of Civil Aviation; And Law No. (1) of 2012 on Organizing Department of Civil Aviation in Emirate of Ras Al Khaimah; And Law No. (2) of 2014 on Amending Law No. (1) of 2012 on Organizing Department of Civil Aviation in Emirate of Ras Al Khaimah ; And Emiri Decree No. (6) of 1999 on Appointing President of Department of Civil Aviation; And upon what the public interest requires. Have promulgated the following: Article (1) It is permitted to strike off, disassemble and recycle aircrafts upon request submitted to Department of Civil Aviation by the companies that own and / or authorized to dispose of aircrafts according to the following terms and procedures: 1- A certificate of striking off the aircraft from the State’s registers in which it is registered and provide the Department with copy of De-registration certificate. 2- No-Objection Certificate from Federal Authority for Nuclear Regulation (FANR) proving that aircraft is free from radioactive materials and depleted uranium and in case the aircraft contains these materials, a possession certificate for these materials shall be issued along with no-objection certificate to remove and dispose of them as per procedures followed in the State. 3- No-Objection Certificate from General Authority of Civil Aviation. 4- No-Objection Certificate from Environment Protection and Development Authority in the Emirate. 5- Clearance Certificate from the airport stating non-existence of any financial obligations on the operator, owner or any third party. 6- Cut the aircraft into parts so that they cannot be reused in the aircraft again in any way. 7- The company should write down numbers of all parts removed from the aircraft and such numbers shall be traceable. 8- Dissembling processes shall be carried out under supervision of aircraft maintenance company that has approvals stated in approved maintenance instructions (Approved Maintenance Organization – AMO 145) for the same type of the stricken off aircraft. 9- Follow laws, systems and procedures of Department of Civil Aviation regarding aircrafts recycling. 10- The company shall observe all security and safety measures inside and outside the airport. 11- After competing cutting process entirely, the company should remove waste and impurities to ensure safety of the site and airport. Article (2) Provisions of this Resolution shall apply to the following aircrafts: 1- Aircrafts that had been decommissioned by a decision from the owner. 2- Aircrafts that had been legally confiscated by the court. 3- Aircrafts damaged due to accident and cannot be returned to service. 4- Aircrafts that airworthiness certificate had been withdrawn therefrom. 5- Aircrafts that had been abandoned for a period exceeding one year and are un-airworthy. 6- Or any aircraft which Department of Civil Aviation, in cooperation with General Authority of Civil Aviation, shall deem un-airworthy and located within the geographical borders of Ras Al Khaimah Emirate. Article (3) A suitable place shall be allocated at Ras Al Khaimah International Airport to carry out disassembling, cutting, recycling and storing processes, provided that such place shall conform to conditions and requirements of security and safety. Article (4) Terms of licensing aircraft disassembling, cutting and recycling company: 1- The company must fill the form of the license to practice the activity. 2- It is required to obtain security approval from security authorities at the airport. 3- Provide proof of the company’s experience in aircraft recycling field. 4- Provide guide for method of cutting and recycling. 5- The company shall have measures to deal with radioactive materials. 6- It shall have experience in dealing with depleted uranium and how to store and dispose of these materials along with providing the Department with what proves this. 7- It shall have procedures for disposal of depleted uranium and radioactive materials in the events of existence thereof in the aircraft, provided that such measures shall conform to procedures followed in the State and in coordination with competent authorities 8- Undertaking letter from the company stating that scrap parts removed from the aircraft shall not be reused in any other airworthy aircraft. 9- The company shall meet safety requirements. 10- Inform Department of Civil Aviation and Air Safety Division at the airport, along with report, of any accident occurred as result of cutting process. Article (5) Prohibitions during practicing activity of aircraft disassembling, cutting and recycling: 1- It is prohibited to cut the aircraft in place not designated for that purpose. 2- It is forbidden to start cutting the aircraft without completely removing the fuel from the tanks and pipes. 3- It is prohibited to reuse the fuel removed from the aircraft to be cut in any other aircraft. 4- It is prohibited to reuse any part without being rehabilitated by the specialists and as stipulated in article 1, paragraph 8. 5- It is forbidden to reuse any part removed from an aircraft that had been decommissioned due to an accident. 6- Cutting is forbidden near fuel stations. Article (6) The Department shall determine striking off, disassembling and recycling charges as per the system approved by Department of Civil Aviation. Article (7) This resolution shall be repealed in the event of promulgating any federal legislation dealing with aircraft striking off, disassembling and recycling. Article (8) This resolution shall come into force as date of its promulgation and be published in the Official Gazette.   • This resolution shall come into force as date of its promulgation and be published in the Official Gazette.
