Executive Council Resolution No. (11) of 2024 On Regulating Licensing Cultivation & Manufacturing Tobacco, Products & Derivatives Thereof In Ras Al Khaimah Emirate We, Mohammed Bin Saud Bin Saqr Al Qasimi Crown Prince of Ras Al Khaimah & President of Executive Council After perusal of the Constitution; And Federal Law No. (15) of 2009 on Combating Tobacco, as amended; And Federal Decree-Law No. (33) of 2021 on Regulating Labor Relations, as amended; And Federal Law No. (13) of 2020 on Public Health; And Cabinet Resolution No. (98) of 2023 on Regulating Licensing Cultivation & Manufacturing Tobacco, Products & Derivatives Thereof; And Ras Al Khaimah Municipality Law of 1981, as amended; And Law No. (2) of 2007 on Establishing Environment Protection & Development Authority in Ras Al Khaimah, as amended; And Law No. (7) of 2012 on Establishing Executive Council of Ras Al Khaimah Emirate; And Law No. (8) of 2016 on Regulating Practicing Economic Activities in Ras Al Khaimah; And Law No. (2) of 2017 on Establishing Ras Al Khaimah Economic Zones and Supervising Authority thereof, as amended; And Law No. (11) of 2023 on Regulating Surveying Works in Ras Al Khaimah Emirate; And based on approval of the Executive Council; have resolved the following: Article (1) In applying provisions of this Resolution, the following words and phrases shall have the meanings stated opposite each thereof, unless context of text requires otherwise: State:United Arab Emirates. Emirate:Ras Al Khaimah Emirate. Executive Council:Executive Council of the Emirate. Competent Authorities: The government authorities, where application of any of this Resolution provisions in the Emirate, shall fall within its competency. Licensing Authority: Economic Development Department & Ras Al Khaimah Economic Zones “RAKEZ”. Department:Ras Al Khaimah Municipality Department. Authority: Environment Protection & Development Authority in Ras Al Khaimah. Article (2) The provisions of this Resolution shall apply to each one who obtains or wants to obtain agricultural and industrial licenses of tobacco, products and derivatives thereof in the Emirate, including Ras Al Khaimah Economic Zones. Article (3) The Licensing Authority shall undertake the following: 1-Allocate places to cultivate tobacco and manufacture products and derivatives thereof in the emirate according to the cadastral chart issued by the Department in coordination with the Authority. 2-Set necessary rules and controls to regulate granting license, determine details and terms thereof and how to amend them, within the framework of legislations in force. Article (4) The Department or whichever it entrusts of competent health authorities shall conduct an annual medical examination for those working in cultivating and transferring tobacco and grant, the medically fit among them for the assigned work, a health certificate of the examination at the expense of the employer. Article (5) The Authority shall study the evaluation of environmental impact of activities related to cultivation and manufacturing of tobacco, products and derivatives thereof and verify meeting the requirements of Ministry of Climate Change & Environment regarding importing tobacco seeds and saplings. Article (6) Nobody may cultivate tobacco or establish nurseries to sell its bush or manufacture products or derivatives thereof except after obtaining license to do so from Licensing Authority. The license application shall be submitted to Licensing Authority according to the rules and controls necessary to regulate granting the same, accompanied by details and documents determined thereby and attached by proof of fees payment. If the application is for establishing tobacco bush nurseries to sell them to farmers, the Applicant should include in his application, in addition to the above, statement of nurseries number and location of each of them, type of saplings to be produced. Article (7) Those licensed to trade in tobacco seeds or establish nurseries thereof may not sell seeds or saplings or transfer or assign the same entirely or partially except to farmers licensed to cultivate tobacco. Article (8) The law officers in the Licensing Authority and competent authorities shall have competence, respectively, to prove what occurs in violation of provisions of the mentioned Cabinet Resolution and provisions of this Resolution. Article (9) Each provision violates or contradicts with the provisions of this Resolution, shall be repealed. Article (10) This Resolution shall be published in the Official Gazette and come into force from date of promulgating it.   • In applying provisions of this Resolution, the following words and phrases shall have the meanings stated opposite each thereof, unless context of text requires otherwise:
