Executive Council Resolution No. (1) of 2025 On Promulgating Regulation of Law No. (10) of 2019 On Practicing Engineering Consulting Profession in Ras Al Khaimah Emirate

After perusal of Federal Decree-Law No. (37) of 2021, on Commercial Register;
And Ras Al Khaimah Municipality Law of 1981, as amended;
And Law of Regulating Buildings No. (1) of 2009;
And Law No. (8) of 2016 on Regulating Practicing Economic Activities in Ras Al Khaimah;
And Law No. (8) of 2019 on Regulating the Practice of Contracting Profession, as amended;
And Law No. (10) of 2019 on Regulating the Practice of Engineering Consulting Profession, as amended;
And Law No. (11) of 2023 on Regulating Surveying Works in Ras Al Khaimah Emirate;
And after approval of the Executive Council;
Promulgated the following Regulation:
Article (1)
Definitions
The following words and phrases shall have the meanings indicated opposite each of them, unless the context of text requires otherwise:
Emirate: Ras Al Khaimah Emirate
Department: Ras Al Khaimah Municipality Department
Director-General: Department Director-General
Competent Administration: Buildings Administration in the Department
Competent Division: Qualification Division affiliated to Competent Administration
Committee: A committee specialized in examining and expressing opinion to the Competent Division
Engineer: A person holding an educational qualification from a recognized university in one of the engineering disciplines and is enrolled in the Society of Engineers in the State and registered with the Department
Engineering Consulting: Works related to preparing drawings, plans, architectural and structural designs, surveying, planning and supervising implementation, maintenance and operation, calculating quantities and estimating costs, managing engineering activities projects, as well as all related to other fields of engineering works
Office: Engineering Consulting Office
Register: An electronic register, in which the consulting offices and engineers accredited by the Department and licensed to practice engineering consulting profession are enrolled and classified
License Holder: The engineer who is legally in charge of the office and represents it before the Department
Article (2)
Fields and Branches of Engineering Consulting
a. Engineering consulting activity in the Emirate shall be limited to the following fields:
1. Architectural Engineering Consulting.
2. Civil Engineering Consulting.
3. Electrical Engineering Consulting.
4. Mechanical Engineering Consulting.
b. The Director-General may – upon Committee’s proposal – add other fields to such fields.
c. Only the engineering disciplines indicated in schedule no. (1) attached to this Regulation, shall provide engineering consulting activity in the fields indicated opposite each of them.
D- The office may add to its activity other fields of engineering consulting from those specified in this Regulation and add engineering disciplines to its cadres, provided meeting terms determined by the Division and approval thereof.
E-The Competent Division may add new engineering disciplines upon the Committee proposal.
Article (3)
Engineers Enrolment & Classification Procedures
The following procedures shall be followed in enrolling and classifying engineers into the appropriate category:
1. The engineer shall submit an application to the Competent Administration that meets the following details and documents:
a. Name, address, nationality, date of birth of the Engineer and copy of Emirates ID.
b. Copy of the academic qualification certificate stating his degree, major, date of graduation, university and country from which he obtained the certificate.
c. Professional experiences obtained in the field of his/her major, number of years, and professional training and accreditation certificates thereof.
d. Number and date of Engineer membership in UAE Society of Engineers.
e. Statement of the engineering consulting offices in which he worked and job tasks assigned to him therein.
f. Good Conduct Certificate.
g. Any other details determined by resolution from the Committee.
2. After completing the details and documents set forth in the first clause of this Article, the Competent Administration shall enrol the engineer in the register on the appropriate category in Table (2) attached to this regulation whenever the following conditions are met:
a. Hold bachelor degree in engineering from one of the recognized universities in the engineering major required to be licensed.
b. To be member in UAE Society of Engineers.
c. To be of good conduct.
d. To have number of experience years that qualify him for the appropriate category in schedule (2) attached to this regulation.
e. Any other conditions determined by a resolution from the Competent Division.
3. It is required to enrol the engineer in the register as holder of an engineering consulting office license, that he must have experience certificates of not less than three years, or two years if he holds postgraduate certificates in an engineering major related to the engineering field of the office and he must meet the conditions mentioned previously in the second clause of this article.
4. It is required to classify the categories and grades of engineers in the register the following:
a. He shall be enrolled in the register and his iqama shall be on the office to be enrolled thereon or has a temporary work permit issued by the concerned authority in the event he is enrolled within the engineering cadre of the office.
b. Availability of the minimum number of experience years as stated in schedule (2) attached to this Regulation.
c. Pass the Department test specified by the Competent Division for each category.
d. The major of the academic qualification and the experiences of the license holder and engineers must be commensurate with the category to be classified thereon.
5. The Committee shall examine the classification and give an opinion to the Competent Division within thirty days from the date of completing the classification details and conditions for the category on which it is requested to be classified.
6. After receiving the committee's opinion of approval, the Division shall issue a registration certificate including the details of the engineer, office and classification category.
7. In case of rejecting the application, the rejection decision shall be reasoned and notified to the engineer by one of the means set forth in Article (15) of this Regulation.
8. The Competent Administration shall have the right to reconsider the engineer enrolment in the register and classify the same based on re-testing him in the following cases:
a. Failure to pass the Department test determined for each category.
b. Obtain an annual performance efficiency assessment for several terms that does not meet expectations.
c. Non-practicing of the profession for more than three years.
d. Other cases determined by a decision from the Director General based on a recommendation from the Competent Division.
9. The register data should be updated continuously, especially those related to enrolment status, classification degree, performance efficiency results, final penalties imposed on the engineer, if any and any other details to be determined by resolution from the Competent Division.
Article (4)
Engineering Consulting Offices Enrollment and Classification Procedures
In enrolling and classifying engineering consulting offices, the following procedures shall be observed:
1. The office shall submit an application to the Competent Administration that meets the following details and documents:
a. The professional name of the office, its location and area, its trade license number, in whose name the license is issued, the names of the partners and the manager in charge, the majors of engineering cadres thereof and the field of consulting licensed to provide.
b. Number of engineers and managerial staff in the office.
c. A statement from Department of Economic Development indicating the applicant's professional licenses and type of activities licensed thereto, whether he is an owner or a partner.
d. Any other details determined by a decision from the Competent Division.
2. The Competent Administration shall undertake the initial entry of the office in the register.
3. After completing all details and documents set forth in the first clause of this Article, the Committee shall express its opinion to the Competent Division in enrolling the Engineering Consulting Office and classifying it on the category mentioned in schedules (3) and (4) attached to this Regulation within thirty days from the date of completing the details and criteria specified for classification.
4. The Director General may amend the classification criteria or add new ones based on a recommendation from the Competent Administration.
5. The Competent Division shall, after receiving the Committee's opinion of approval, issue the registration certificate for the office, indicating therein the office details and the classification category.
6. In the event of rejecting registration and classification, the Competent Division shall issue a reasoned decision to that effect and notify the Office thereof by one of the means set forth in Article (15) of this Regulation.
7. The details of enrolment register of engineering offices must be updated continuously, particularly, the office space share for them, registration and classification status, performance efficiency results, suspensions cases, penalties details, if any, any other details to be determined by resolution from the Competent Division.
8. Engineering office license holder or his representative must notify the Competent Administration of any change in the details of office license or the technical staff within thirty days from the date of the change.
9. The Committee may, at any time, cancel the registration in case of missing or violating one of the conditions necessary for enrolment or classification stated in the provisions of this Regulation and the law issued in implementation thereof.
Article (5)
Engineering Consulting Offices Forms
The registered and classified engineering consulting office in the Emirate shall take one of the following forms:
1. Local Engineering Consulting Office:
It is an engineering consulting office whose main branch shall be established and licensed in the Emirate.
2. Extern Engineering Consulting Office Branch:
It is a branch of an engineering consulting office licensed in one of the State’s emirates and registration and classification thereof shall require the following:
a. The period of practicing a specific activity in the fields of engineering consulting stated in this Regulation shall not be less than three years in one of the State’s emirates.
b. To have the engineering cadre specialized in the fields of engineering consulting required to be enrolled and classified to practice them.
c. To be enrolled and classified in accordance with the procedures followed in the Department.
1. Foreign Engineering Consulting Office Branch:
It is a branch of a foreign engineering consulting office to be established in the Emirate and registration and classification thereof shall require the following:
a. The field and major required to be enrolled and classified thereon must be among the fields and majors stated in this Regulation and the period of practicing them outside the State shall not be less than five years.
b. To have the engineering cadre specialized in the engineering field required to be enrolled and classified for the practice thereof.
c. To have a licensed branch in one of the State’s emirates for a period not less than three years on the date of enrolment and registration application.
d. To have previous experience in number of projects of pioneering engineering quality completed solely and submit in the classification documents a list of these projects accompanied by their contracts or certified completion certificates thereof.
e. To be managed by an engineer enrolled and classified in the Department in accordance with the procedures and conditions determined for the classification category and degree and the period of practicing the profession shall not be less than five years in the engineering major and the field of engineering consulting required to be enrolled and classified for the practice thereof.
3. Joint Engineering Consulting Office:
It is a joint office – established in accordance with the provisions of Companies Law – between a local engineering consulting office classified as first category and a foreign engineering office that has no branch within the State, to practice engineering consulting and it is required to enroll and classify it that the foreign office shall meet the following conditions:
a. Conditions to be met for enrolment and classification of foreign office branch referred thereto in the third clause of this Article.
b. Its field and major shall be of the same type and major as the local office enrolled and classified in the Department.
c. To have practiced the engineering field and major to be enrolled and classified for a period not less than five years.
d. It shall not be partner in any of the other local engineering consulting offices.
2. Expert Engineer Office:
It is an office whose role is limited to expressing opinion in the critical engineering disciplines of local or joint engineering offices or any of the official authorities and bodies in the Emirate and it is required for the license applicant therein to meet the following:
a. Holding an accredited degree in the critical engineering discipline.
b. To have practiced the profession in critical discipline for a period not less than fifteen years.
c. Carry out the licensed activity himself.
Article (6)
Classification Modification Mechanism
1. If the engineer or office applies to modify his/its classification to the Competent Division, the following procedures shall be followed in considering the application:
a. The Competent Division shall examine the application and verify that it meets the requirements of the classification category stated in schedules nos. (3) and (4) attached to this Regulation in accordance with the standards established for that.
b. The Competent Division shall issue office registration certificate indicating therein the new classification details and category after approving the modification of classification category within thirty days of fulfilling the requirements for modifying the required classification category.
2. In the event of application rejection, the rejection decision should be reasoned and notified to the Office by one of the means set forth in Article (15) of this Regulation.
Article (7)
Manager In-Charge Appointment
The license holder shall be responsible for signing the contract with the project owner or his authorized representative and without prejudice to the liability of the license holder to the Department, he may appoint a Manager In-Charge of the office who shall be entrusted with the functions of singing and acting on behalf of the office and who shall meet the following conditions:
1. To be an engineer enrolled in the register of practitioners of engineering consulting profession.
2. To be entirely devoted to the office business.
3. To have the experience period that should be met by the license holder.
Article (8)
Engineering Consulting Services Contract
The Engineering Office should conclude the engineering consulting services contract including the minimum limit of the following details and terms:
1. Contract date, parties, addresses of parties and means of communication among them.
2. Engineering works, subject matter of the contract.
3. The period agreed thereupon to implement the works during it.
4. The fees agreed thereupon and method of paying them.
5. All tasks and obligations of the office in the project.
Article (9)
Criteria for Determining Share of Projects Areas for Engineering Consulting Offices
1. An administrative resolution shall be issued by the Director General specifying the share of projects areas assigned to consulting offices.
2. In the event that an office project is suspended by a decision from the Competent Administration, a share shall be added thereto instead of the suspended project share based on a decision from the Committee in accordance with the approved standards and conditions therewith.
Article (10)
Engineering Consulting Offices Performance Efficiency Assessment
1. The Competent Division shall periodically update the data of offices performance efficiency in accordance with the specified performance indicators and standards.
2. The Committee shall assess offices performance efficiency periodically and in the event that the Office obtains an evaluation that does not meet its expectations for more than one period, the Office shall be suspended from receiving new projects until raising its efficiency and improving the level of its performance.
Article (11)
Registration Renewal
1. The office shall apply to the Competent Administration to renew its registration within two months before the date of expiry of the registration period and it shall be renewed for a full year, provided that enrolment conditions shall not be violated and the determined fee is paid.
2. Failure to renew the registration on the specified date shall result in cancellation of the office's registration and suspension of all its work and those contracting therewith may apply to the Department to change the consultant in accordance with the procedures followed.
3. In case of cancelling the office registration due to non-renewal on the specified date, the Office shall have the right to re-apply to the Competent Administration for renewal after paying the fee and delay fine stated in fees and fines schedule.
Article (12)
Registration Suspension
a. The Office may apply to the Competent Administration during the validity period of its registration to suspend registration thereof for a period not less than three months, provided that it does not have projects or obligations towards third parties and the application shall be considered within thirty days from the date of submitting it.
b. After the expiry of suspension period, the office Manager in Charge shall submit a request to the Competent Administration to resume registration validity, unless suspension expiry date coincides with the date specified for submitting registration renewal application, then, the office should apply for registration renewal.
c. The suspension of registration shall not result in compensation for period thereof after the expiry of registration period.
Article (13)
Registration Cancellation
The Office may apply to the Competent Administration to cancel enrolment thereof in the register under the following conditions:
1. Non-existence of any obligations towards third parties or contracted projects, unless a disclaimer is submitted by the owner and the contractor in respect thereof.
2. Submit proof of cancelling the professional license from the concerned authority.
3. Any other conditions issued by a resolution from the Competent Administration Manager.
In case all conditions and requirements are met, the Competent Division shall cancel the registration and issue a certificate to that effect after paying the due fee and the office shall bear full responsibility towards third parties for cancelling its registration and in case of rejecting the request, the decision must be reasoned.
Article (14)
Office Change Mechanism
The owner may apply to the Competent Administration to change the office in accordance with the procedures and conditions issued by a resolution from the Director General.
All liabilities incurred by the old office shall be transferred to the new office from the date of the Competent Administration approval on the change request under the following conditions:
1. Submit technical report certified by the Competent Administration and issued by the old office indicating the project status, current phase, the extent of its conformity with the issued building license and approved charts before the change till date of issuing the report. In case the old office failed to submit this report, the project owner or Competent Administration shall assign the new office to prepare the same.
2. A declaration from the new office to study the design, approved charts and the technical report mentioned above in this article and be acquainted with content thereof.
3. Any other conditions issued by resolution from the Competent Administration.
Article (15)
Means of Notification
The notifications shall be addressed from the Competent Administration to the office by the following means:
1. Notify the License Holder or Office Manager personally.
2. Paste the notification on an apparent place in the premise of the office registered with the Department.
3. Via express, registered or electronic mail registered with the Department.
4. Via SMS or Department’s approved applications.
5. Any other mean approved by Director General.
Article (16)
Cash Guarantee and Its Refund Mechanism
1. The Director General shall issue a decision specifying the cash guarantee to be deposited by the office in the Department treasury to issue the initial registration certificate and practice the activity according to the engineering field of the office and category thereof.
2. The office may request cancelling the initial registration before the expiry of its term and refund cash guarantee and if the registration certificate expired without renewing it and the licensing procedures have not been completed, then, the registration shall be considered null and void and the right to refund the security deposit shall be forfeited and devolved upon the public treasury.
3. The cash guarantee for approving the assignment of a project to an office higher than its classification category or assigning a project to an office from outside the emirate, shall be recovered after the completion of the project, the issuance of completion certificate and obtaining an express approval of the Department on the refund request.
Article (17)
Grievance
The office may appeal from the decisions of the Competent Administration before Grievance Committee in the Department by a request submitted within fifteen days from the date of being notified of the decision and the Grievance Committee shall decide on the grievance within one month from the date of its submission and the decision issued by it shall be final.
Article (18)
Office Violations Reconciliation Request
The office may apply for reconciliation in respect of any of its violations within fifteen days from the date of notifying it thereof and the Committee shall consider the request within one month from the date of its submission whenever the following conditions are met:
1- The violation shall not be one of the violations that breach the Code of Ethics for practicing the profession or the requirements of security and safety.
2- Remove violation reasons within the period determined by the Committee.
3- Pay value of damages caused by the violation to public property.
4- Pay half of fine amount.
Article (19)
Electronic Connectivity
All departments and authorities shall coordinate, cooperate and electronically connect with the Department to implement the provisions of Law No. (10) of 2019 on Regulating the Practice of Engineering Consulting Profession and this Regulation and the resolutions issued pursuant thereto.
Article (20)
Regularization
The engineering consulting offices registered with the Department shall regularize status thereof in accordance with the provisions of this Regulation within one year from promulgation date thereof.
Article (21)
Previous Resolutions Repealing
Each provision in another resolution that contradicts with the provisions of this Regulation shall be repealed.
Article (22)
Regulation Coming Into Force
This Regulation shall come into force from its promulgation date and be published in the Official Gazette.
