Executive Council Resolution No. (8) of 2025 On Approving Fees and Violations Schedules of Law No. (10) of 2019 On Regulating Practice of Engineering Consulting Profession
We, Mohamed Bin Saud Bin Saqr Al Qasimi
Ras Al Khaimah Crown Prince
& Chairman of Executive Council
After perusal of Federal Decree-Law No. (42) of 2022 on Promulgating Civil Procedures Law;
And Ras Al Khaimah Municipality Law of 1981, as amended;
And Law No. (7) of 2012 on Establishing Executive Council of Ras Al Khaimah Emirate;
And Law No. (10) of 2019 on Regulating the Practice of Engineering Consulting Profession in Ras Al Khaimah emirate, as amended;
And after approval of the Executive Council;
have promulgated the following Resolution:
Article (1)
The two schedules of fees and violations attached to this Resolution shall be approved.
Article (2)
Without prejudice to any more severe penalty stipulated by another law and measures stipulated by Law no. (10) of 2019 referred thereto, everyone commits any of the violations stated in the schedule attached hereto shall be punished by the fine determined for it and the fine shall be doubled in case of repeating the same violation within one year from the date of committing the previous one.
Article (3)
Any interested party may file a grievance with the Municipality Department regarding the fines and measures imposed thereon in application of this Resolution provisions, within fifteen days from the date of notifying him of the fine or measure and Grievance Committee in the Department shall decide on the grievance within thirty days from the date of submitting it and the decision issued in the grievance shall be final.
Article (4)
The following conditions must be met to reconcile any of the violations stated in the schedule of violations attached hereto:
1. The violation must not be one of the violations that breaches Code of Ethics for practicing the profession or the requirements of security and safety.
2. Remove violation causes within the period determined by the Committee.
3. Pay the value of damages caused by the violation to public property.
4. Pay half of fine value.
Article (5)
All fees and fines collected under this Resolution shall devolve upon treasury of the Department and the unpaid thereof shall be collected through a claim issued by the Department Director General or his delegate that includes the name of the debtor and his legal representative and the due amounts and this claim shall be considered writ of execution to be executed by the competent Execution Judge in accordance with Civil Procedures Law.
Article (6)
Each provision in other Resolution contradicts with provisions of this Resolution shall be repealed.
Article (7)
This Resolution shall come into force as date of its promulgation and be published in the Official Gazette.
