Law No. (9) of 2025 On Organizing Promotional Campaigns & Special Offers For Commercial Advertising Purposes

And Federal Law No. (15) of 2020 on Consumer Protection;
And Federal Decree-Law No. (50) of 2022 on Promulgating Commercial Transactions Law;
And Federal Decree-Law No. (14) of 2023 on Commerce Through Modern Technology Means;
And Federal Decree-Law No. (55) of 2023 on Media Regulation;
And Law No. (11) of 2008 on Advertisements Control;
And Law No. (7) of 2012 on Establishing Executive Council of Ras Al Khaimah Emirate;
And Law No. (9) of 2017 on Organizing Using Electronic Deeds and Signatures in Ras Al Khaimah Emirate;
And Law No. (2) of 2025 on Organizing Department of Economic Development in Ras Al Khaimah;
And Law No. (6) of 2025 on Organizing Sale by Discounted Prices in Ras Al Khaimah;
And after approval of the Executive Council;
have promulgated the following Law:
Article (1)
Definitions
In applying provisions of this Law, the following words and phrases shall have the meanings corresponding to each of them respectively, unless text context requires otherwise:
Emirate: Ras Al Khaimah.
Department: Economic Development in the Emirate.
Chairman: Department Chairman.
Director General: Director - General of Economic Development Department.
Committee: Customers Complaints & Grievances Committee in the Department.
Commercial Shop: The main office of the establishment or any of its branches, whether physical or virtual, which has been licensed by the Department to practice the activity within the Emirate.
Promotional Campaign: A marketing business event or practice carried out during a specific period of time, aims at enhancing public awareness of a product or service and encourages them to take specific action, such as trial, purchasing or registering in commodity or service request lists.
Special Offer: A commercial practice aims at increasing sales or clearing goods by offering discounts or additional benefits during specific periods, such as end of seasons or occasions.
Permit: A document includes explicit approval issued by the Department to the commercial shop to conduct a promotional campaign or special offer, in accordance with the provisions of this Law.
Organizer: The commercial shop authorized to carry out a promotional campaign or special offer, responsible before the Department and consumers for fulfilling all legal, regulatory and advertising obligations, whether it undertakes the execution itself or seeks assistance of others.
Gifts: Rewards, in-kind benefits or services granted directly to the consumer when purchasing a commodity or obtaining a service, without entering into a draw or lucked procedure.
Award: A cash or in-kind reward granted to the consumer based on a mechanism that depends on luck, whether through an immediate win or a deferred draw, according to predetermined terms and criteria.
Draws: A promotional mechanism through which the consumer, upon purchasing a product or service, receives a numbered voucher issued in both Arabic and English, consisting of two parts; one part is placed in the draw box or the approved electronic system, and the consumer keeps the other part to claim the prize upon wining. The voucher may be paper one or digitally generated electronically from reliable systems linked to purchase data.
Article (2)
Obtain The Permit
Anyone who wants to organize a promotional campaign or provide special offer must obtain a permit from the Department, by applying online or through service windows at least seven days before the scheduled start date of the campaign or offer.
Article (3)
Permit Grant Conditions
It is required to obtain a permit to conduct promotional campaign or special offer, the following:
1. The commercial shop license shall be valid at the time of submitting the application.
2. Provide a headnote in Arabic that explains implementation mechanism and objectives of the campaign or offer.
3. Provide a detailed statement of awards types and value thereof, accompanied by proof of their availability or provide sufficient guarantee for receiving them.
4. Set the draw date and the method of execution, whether by manual lottery or electronic draw.
5. Provide samples of the advertising and promotional materials intended to be used, provided that they shall be in Arabic and in English where applicable.
6. Provide a statement of the locations participating in the campaign or offer, if any.
7. Provide proof of approval from the owner or supervising authority of the external site if the activity involves displaying a vehicle, installing a platform, or distributing promotional materials outside the establishment premise.
8. Submit all prizes documents to the Department upon conducting drawings within the Emirate.
9. Attach a permit from the competent authority in the concerned emirate if it has been decided to carry out the draw in another emirate.
10. Submit a letter from the parent company in the event of making the draw abroad, specifying details and location thereof.
11. Meet all conditions and controls issued by the competent authorities as per nature of the activity or awards type.
12. Adhere to any other conditions issued by resolutions from the Department in implementation of the provisions of this Law.
Article (4)
Decide On Application & Grievance
The Department shall decide on the permit application within seven working days from the date it is received with all required documents and shall notify the relevant party of its decision. The lapse of this period without a response shall be considered as an implicit rejection of the application.
The relevant party may appeal to the Committee within seven working days from the date of being notified of the decision or from the date on which the request is deemed implicitly rejected.
The Committee shall commit to deciding on the grievance within seven working days from the date of receiving it and the laps of this period without a response shall be considered as a final rejection of the grievance.
Article (5)
Promotional Campaigns Forms
The promotional campaign shall take one of the following forms:
1. Present awards to consumers, whether they are instant ones given directly based on luck mechanism, such as 'Scratch and Win,' or through draws held at specific times for cash or in-kind awards, such as vehicles or electronic devices.
2. Present free gifts or samples.
3. Offer free drinks or food to introduce the product to the audience or promote it.
4. Provide free services with the aim of introducing the service or encouraging the consumer to try it.
5. Use specialized promoters to introduce the product or service to consumers and explain features and advantages thereof.
6. Display commodities in unconventional ways in public places for promotional purposes.
7. Organize promotional events or induction business openings when launching new establishments with the aim of attracting customers.
Article (6)
Special Offers Forms
The special offers shall be in one of the following forms:
1- Present gifts or privileges that are granted conditionally on purchase, such as receiving a free gift, partial reimbursement of the paid amount or providing accompanying services free of charge.
2- Foodstuff or consumables offers, such as offering an additional free product along with the main product—whether stuck thereto or included in its package or discounting the price of some goods or offering them as part of a bundled deal at a reduced total price.
3- Offers provided by service establishments that include professional activities offered by medical centers, beauty establishments, maintenance services and the like.
4- Seasonal offers which are presented on the occasion of public events or special occasions for a duration not exceeding seven consecutive days.
5- Flexible offers presented on specific days of the week or during weekends, provided that their cumulative duration shall not exceed three months annually.
Article (7)
What Is Considered Promotional Campaign Or Special Offer
Each practice that implies citation of the existence of price advantages or exceptional offers, whatever the name thereof, such as: “sales”, “discounts”, “distinctive prices”, “competitive prices”, “special prices”, “price slashing”, “preferential prices”, “big surprises”, “buy and get a free gift”, “everything at a certain price”, “unmissable offers”, “amazing prices”, or the like that implies an unusual promotion of commodities or services, shall be considered forms of promotional campaigns and special offers. Also, any practice adopted by the Department to achieve the objectives of this Law, even if its name or executive form differs, shall be one form thereof.
Article (8)
Permit Term
The permit shall be granted for a term not exceeding sixty days each time and the Department shall determine the time interval between each term according to the nature of the campaign or the offer.
The term of the permit for promotional campaigns that include prize draws may not be less than fifteen days.
Article (9)
Relevance Between Promotional Campaign Term and Prizes Value
The term of the promotional campaign that includes prizes shall be determined as follows:
1. A term of no less than fifteen days and no more than thirty days if the total value of the prizes shall not exceed ten thousand dirhams.
2. A term of no less than thirty days and no more than sixty days if the total value of the prizes exceeds ten thousand dirhams and does not exceed fifty thousand dirhams.
3. A term of no less than sixty days and no more than one hundred twenty days if the total value of the prizes exceeds fifty thousand dirhams, provided that two draws shall be conducted during this term and the prize of each one shall not be less than fifty thousand dirhams.
Article (10)
Permit Extension
The Department may, upon request submitted by the authorized person, extend the permit for an additional term, provided that the request is submitted before the permit expires and the fees prescribed for the extension are paid. The extension shall take effect from the day following the expiration of the previous permit. The promotional campaign may not be extended if permit thereof includes prize draws; however, the Department may approve a request to postpone the prize draw date, provided that the request is based on justified reasons acceptable to the Department and the applicant announces the new draw date through the means approved by the Department and updates the approved draw schedule.
Article (11)
Exception From Permit Term
As an exception to the maximum term of the permit, the Department may permit promotional campaigns or special offers for a period not exceeding six months, subject to the following conditions:
1. The promotional campaign shall include prize draws with a total value of ten thousand dirhams and above, provided that at least one draw is conducted every two months during the permit term.
2. The special offers shall be limited only to foodstuff or consumables offers.
3. Pay fees equivalent to double the amount of the standard permit fees or the fees determined by a resolution issued by the Director General, taking into account the nature of the campaign or offer and the type of each.
Article (12)
Permit Applicability To Branches
The permit issued to the commercial shop shall be in force for all branches thereof that engage in the same activity and carry the same trade name and after payment of prescribed fees for each branch separately and in accordance with the controls set by the Director General.
Article (13)
Authorized Person Obligations
The person authorized to conduct promotional campaign or special offer should adhere to the following:
1. Not to increase in prices of commodities or services above the approved price before the beginning of the campaign or offer.
2. Ensure that the promoted commodities comply with standard specifications and are fit for consumption or use.
3. Collect draw coupons in the designated box under the supervision of the Department.
4. Conduct prize draw on the scheduled times.
Article (14)
Cancel The Promotional Campaign That Includes Prizes
No promotional campaign that includes prizes or draws may be canceled except after meeting the following conditions:
1. Obtain Department's approval before taking any action that would result in cancellation.
2. Award the announced prizes to the winners if the draw is held before the cancellation.
3. Leave prizes that cannot be drawn or delivered with the Department in accordance with the procedures it determines.
4. Announce the cancellation and reasons thereof and state the prizes' status through a channel approved by the Department.
5. Submit a detailed report to the Department within ten days from the date of cancellation, indicating what has been done regarding the prizes and the status of the participants.
6. State measures taken to ensure transparency and protect the acquired rights of participants, along with attaching the supporting documents.
Article (15)
Promotion and Advertising Means
The Organizer may not promote the products or services subject to the promotional campaign or special offer by any advertising or promotional means, whether paper one, electronic, through solid figures, banners, posters or display media, including advertisements on shopfronts or via the Internet; except after obtaining permit from the Department and paying the prescribed fees, in addition to obtaining a license from the competent authority if requirements thereof are met.
Article (16)
Advertising Voucher Fees
The Department shall approve advertising vouchers related to organizing promotional campaigns and special offers as follows:
1. Flat fee of three hundred dirhams for each promotional campaign or special offer.
2. Proportional fee of (5%) of the total value of discounts or facilities subscription tickets sale price.
Under resolution by the Executive Council, based on a proposal from the Department, these fees may be adjusted in accordance with regulatory requirements and to ensure the quality of promotion and marketing environment.
Article (17)
Data to be Included in Prize Draw Permit Application
Prizes draw permit application must include the following data:
1. Statement of prizes types, along with specifying whether they are in-kind or cash, conditions for winning them and the mechanism for distributing them to participants inside the commercial shop or through the approved electronic platform.
2. Draws dates and the mechanism for implementation thereof, with the Organizer's commitment to notify the Department periodically of the draws schedule, whether they are daily or weekly, through the means approved by the Department.
3. Set the final draw date no later than three working days from the end date of the campaign.
Article (18)
Organize Electronic Draw
In case of organizing the draw electronically, the following must be adhered to:
1. Use approved and secure electronic systems that issue electronic tickets or coupons that are numbered sequentially, dated and subject to verification and review.
2. Include the invoice or transaction number and an effective means of communication with the customer in the electronic ticket details.
3. Link all electronic tickets to actual purchase transactions.
4. Document the draw electronically by an official report or visual recording, along with keeping the records for no less than three months from the end of the campaign and presenting the same to the Department upon request.
5. Comply with all provisions prescribed for manual draw, including documenting the prizes, announcing the names of the winners and handing over unclaimed prizes to the Department.
Article (19)
Voucher Box Specifications
The following are required for voucher collection box:
1. It shall be transparent and of a suitable size that matches the expected number of vouchers.
2. To be equipped with rotation mechanism that ensures the vouchers are mixed in a balanced and fair manner.
3. The draw opening should be proportional to the size of the box to ensure the integrity and fairness of draw process.
4. The box shall be tightly closed throughout the campaign term, under the direct supervision of the Department.
The Department may oblige the Organizer to use technical control means that enable it to review and monitor all steps of the box's usage.
Article (20)
Prizes and Financial Guarantees Availability
Prizes and gifts allocated for the winners must be available and deliverable before the draw date, comply with the approved standard specifications, free from defects and covered by the guarantees prescribed for similar items. If the prize is monetary and exceeds fifty thousand dirhams, the Organizer must provide a certified bank cheque issued by an accredited bank for the equivalent value of the prize.
In all cases, the Department may ask the Organizer to provide a bank guarantee letter issued by an accredited bank covering the total value of the prizes, as a guarantee for the rights of the participants.
Article (21)
Announce Winning Vouchers
The Organizer is committed to announcing the names of the winners and the winning vouchers numbers through at least one of the following means:
1. The official website of the establishment or the campaign's online platform.
2. The approved official accounts of the establishment on social media.
3. Direct notification to winners via text messages or the email registered in the vouchers.
4. Publication in a daily newspaper issued in Arabic within the State.
The Department may oblige the establishment to use a specific announcing method for considerations related to the nature of the campaign or complaints regarding transparency.
The announcement must include information that allows participants to verify the draw results, while ensuring privacy by only mentioning the initials of the winners' names and their vouchers numbers or codes without disclosing their full names.
Article (22)
Announcement Documentation and Publication Proof
The Organizer must keep a copy of the winners’ announcement, whether it is published electronically or on paper, however, this copy must include the following data:
1. Promotional campaign permit number and its issue date.
2. Names of the winners and winning vouchers numbers or winning tickets codes.
3. Publishing date and time.
A copy of the announcement must be submitted to the Department within no more than five working days from the date of publication.
Article (23)
Prize Collection Time Limit
Winners shall be granted a period of two months to claim their prizes, starting from the date the winning vouchers or names are announced. After this period, the right to claim the prize shall be abated for anyone who has not received it.
Article (24)
Dispose of Unclaimed Prizes
Prizes, whose owners’ right to claim has been abated or have not been won by anyone, shall be allocated to public benefit establishments in the Emirate, under the supervision of the Department and in accordance with the controls and procedures set thereby.
Article (25)
Prevent Participation of Related Parties
Authorized persons, their spouses, relatives up to the fourth degree, employees, product distributors or commercial agents are prohibited from participating in prize draws for promotional campaigns that they organize or supervise.
Article (26)
Ban on Tobacco and Products Thereof
It is prohibited to organize any promotional campaigns or special offers for tobacco, products or derivatives thereof by any direct or indirect means aiming at encouraging its consumption.
Article (27)
Draw Announcement
The Organizer must announce the date, location and method of attending the draw, using a means that allows participants to view details thereof well before conducting it.
Article (28)
Monitor Promotional Offers and Attending Draws
The Department shall monitor promotional offers and oversee draw processes, whether conducted by manual lottery or through automated means.
No prize draw may be conducted except in the presence of a representative of the Department and presence thereof is considered valid whether physical or remote. The draw shall be considered invalid if conducted without presence thereof.
This does not apply to draws for which the Department explicitly decides that the presence of its representative is not required, considering prizes value or the availability of strict electronic monitoring methods that ensure the integrity and transparency of the procedures.
When using the automated draw system, trial draw must be conducted to verify the system's efficiency and fairness before the actual draw.
Article (29)
Conditions and Requirements for Printing Prize Tickets
Participation tickets must clearly and accurately include the following information:
1. Ticket serial number.
2. Permit applicant name.
3. Permit number and date of issue.
4. An explicit phrase indicating that the ticket is issued against the purchase of a commodity or service
5. A statement of allocated prizes.
6. Ticket expiry date, campaign end date and draw date.
Article (30)
Draw Procedures
The draw shall be conducted publicly on all vouchers or tickets at the time, place and by the means specified in the permit, whether it is conducted by manual lottery, automatic draw or any other method authorized in the permit.
Article (31)
Change Draw Time or Location
No change may be made to the draw date, its location or the number of tickets permitted to be issued except in cases of extreme necessity and after obtaining approval from the Department.
In all cases, it is required to announce any change using the same announcement means that was used to promote the campaign.
Additional fees shall be collected for each change in accordance with the fee schedule approved by the Department.
Article (32)
Substitute Draw
The prizes draw must be conducted twice consecutively for each prize, so that an original winner is selected in the first draw and a substitute winner in the second draw, to address the situation where the original winner does not come forward to claim prize thereof within the specified period.
Article (33)
Organize Prizes Receipt and Organizer Obligations
Immediately after the draw, the Organizer must do the following:
1. Fill in the details of each prize in a receipt from those prepared by the Department according to the number of prizes awarded.
2. Write down winner's details in the receipt, attach copy thereof and original participation voucher to the receipt and hand over all of them to the Department
3. Follow up receiving the prizes by the winners during the campaign term or within the terms set by the Department's instructions.
4. Refrain from publishing any data or photos of the winners through any advertising or promotional means unless their explicit consent has been obtained.
5. Provide proof that the winners have received their prizes, accompanied by documents verifying their identities and the parts of the winning vouchers, within a period not exceeding thirty days from the end date of the campaign or the last draw.
6. Hand over unclaimed prizes to the Department within a period not exceeding two months from the date of announcing the draw final results.
7. Remove all advertising and promotional materials related to the campaign, especially those published via the establishment's electronic channels.
Article (34)
Judiciary Police and Control Powers
The Department’s employees who have the capacity of law officers are empowered to monitor implementation of this Law’s provisions and resolutions issued in implementation thereof.
in order to do this, they shall be entitled to enter the commercial shops and places of organizing promotional campaigns and special offers to look into registers and documents related thereto and obtain copies thereof when needed and make reports of seized incidents and violations.
They may seek assistance of competent authorities, including police, when needed.
Article (35)
Penalties
Without prejudice to any more severe penalty stipulated in any other law, anyone violates provisions of this Law or resolutions issued in implementation thereof shall be punished by a fine not less than one thousand dirhams and not more than one hundred thousand dirhams.
The penalty shall be doubled in case of committing the same violation within one year from the date of committing the previous violation.
The Department may, after the reasons of the violation have been removed, reach a settlement with the violator in consideration of paying an amount not less than half of the maximum limit of prescribed fine.
Article (36)
Precautionary Measures
By a decision from the Director General, one of the following preventive measures may be taken against the violator:
1. Forbid him from organizing promotional campaigns or special offers, or both, for a period not exceeding one year.
2. Temporarily suspend the promotional campaign or special offer or cancel the issued permit if it is found that the permit has been issued based on incorrect information or it is proven that the method of executing the campaign or offer has caused unacceptable harm to market competitiveness or consumers' rights.
In the event of cancelling the permit, the prizes shall be handled in accordance with the provisions established for prizes that cannot be drawn or those which the winners did not come forward to collect.
Those concerned may appeal against the resolutions issued in application of the provisions of this article within sixty days from the date they are notified thereof. The grievance shall be decided on within thirty days from the date of its submission and the lapse of this period without a response shall be considered an implicit rejection of the grievance.
Article (37)
Executive Resolutions
The Chairman and Director General, each within competence thereof, shall issue necessary resolutions to implement the provisions of this Law.
Article (38)
Repeal Previous Provisions
Law no. (5) of 2016 on Promotional Campaigns and Special Offers for Commercial Advertising Purposes shall be repealed, also as well each provision violates the provisions of this Law.
The policies, systems, regulations, decisions and circulars issued before the provisions of this Law come into effect shall continue to be applied, provided they do not conflict with provisions thereof, until they are replaced in accordance with the provisions of this Law.
Article (39)
Law Enforcement
This law shall come into force as date of its promulgation and shall be published in the Official Gazette.
