Emiri Decree No. 21 of 2009 On Establishing Ras Al Khaimah Maritime City We, Saud Bin Saqr Bin Mohamed Al Qassimi Crown Prince & Deputy Ruler After perusal of Saqr Port Law of 1977, Saqr Port Regulations of 1977 and Saqr Port Fees Law of 1977; And Free Zone Code of 2000, as amended; And Emiri Decree No. 4/94 on Establishing Saqr Port Authority; And Resolution dated on 13/1/1996 on Establishing The Free Zone; And based on what is required by public interest; Have promulgated the following: - Article 1 A) A corporate body named “RAK Maritime City” shall be established under this Decree in the industrial area indicated on the attached map, located in Halilah Island in Emirate of Ras Al Khaimah which area is amounting to 6.000.000 square meter and it shall be fully owned by Saqr Port Authority. B) This area, on which RAK Maritime City to be established, shall be considered a free zone that is subject to laws and regulations in force in free zones provided that it shall be managed and supervised by Saqr Port Authority. Article 2 Taking into consideration the aforesaid, RAK Maritime City shall be subject to a specific system approved by H.H. The Ruler or His representative based on what is presented by Saqr Port Authority, and according thereto, the administrative structure, financial system and internal regulations necessary to manage the affairs of the corporation and achieve the objects thereof shall be determined. Article 3 RAK Maritime City aims at achieving the following objectives: 1- Provide high-quality industrial / maritime complex for maritime industries related to the port such as ship building and repairing, establish silos and support maritime operations, ship services, build and rent stores, warehouses and processing operations. 1- Provide high-quality logistic / industrial infrastructure to facilitate and support industrial development in Ras Al Khaimah. 2- Provide competitiveness for existing industries and cause to attract new industries to emirate of Ras Al Khaimah. 3- Provide appropriate environment for ships used in industries which business require obtaining sea frontage. 4- Cause to improve and develop gas and oil industries and/ or cooperate with some companies existing in the site. 5- Provide high-quality facilities, support amenities, provide required warehouses, store dry goods, provide offices, administrative, medical and recreational buildings, parking lots, maintenance workshops,,,,,, etc. 6- Attract high-technology secondary industries that can benefit from the products of domestic heavy industries. 7- Develop strong strategies, policies, management systems, plans and procedures according to related federal laws/ international standards and best practices. 8- Provide high levels of concentration in serving the clients. Article 4 The administration of Saqr Port Authority shall undertake managing RAK Maritime City and develop, improve, invest and market this city and shall be granted all necessary powers, including right to negotiate and conclude all contracts and agreements to develop and invest RAK Maritime City and dispose of the same, as it deems fit. RAK Maritime City shall be entitled also to open one account or more in its name with a bank or more within or outside Ras Al Khaimah and in this respect, The Crown Prince & Deputy Ruler shall issue an authorization to one person or more to manage and operate this account, deposit, withdraw therefrom, etc. according to content of the authorization Article 5 RAK Maritime City shall practice the following powers and competencies through Saqr Port Authority: 1- Issue licenses to corporations and companies that have the desire to practice business in the free zone of RAK Maritime City and collect the determined fees and expenses. 2- Incorporate companies, enter into partnerships with third parties, invest in different projects and rent and/or develop plots granted thereto by Ras Al Khaimah government and collect the determined fees and charge. 3- Coordinate with different corporations, bodies and concerned federal and local authorities in implementing the laws related to economic activities. 4- Any other competencies and tasks assigned to RAK Maritime City by H.H. The Ruler or His representative. Article 6 Land Department shall register the above-mentioned area in the name of RAK Government / RAK Maritime City and issue registration deeds thereof. Article 7 Every previous decree or resolution which provisions contradict with the provisions of this decree shall be cancelled Article 8 This decree shall come into force from the date of its issuance and concerned authorities shall execute the same each within the limits of its competence and be published in the Official Gazette.
