Executive Council Resolution No. (16) of 2025 On Promulgating Executive Regulation of Law No. (3) of 2023 On Controlling Public Health Pest Control Pesticides Trading We, Mohammed Bin Saud Bin Saqr Al Qasimi Crown Prince of Ras Al Khaimah & Chairman of the Executive Council After perusal of Federal Law No. (10) of 2020 on Pesticides, as amended; And Law No. (7) of 2012 on Establishing Executive Council of Ras Al Khaimah Emirate; And Law No. (3) of 2023 On Controlling Public Health Pest Control Pesticides Trading; And Cabinet Resolution No. (27) of 2012 On Regulating Public Health Pest Control Pesticides Trading; And Ministerial Resolution No. (714) of 2015 On Proper Disposal of Damaged Pesticides and Empty Pesticide Containers; And Cabinet Resolution No. (16) of 2019 On Pesticides Advertisement System; And Ministerial Resolution No. (27) of 2018 On Pesticides Registration & Importation Procedures; And Ministerial Resolution No. (36) of 2018 On Prohibited & Use-restricted Pesticides in United Arab Emirates; And after approval of the Executive Council; have promulgated the following Regulation: Article (1) Definitions In applying provisions of this Regulation, the definitions stated in Law No. (3) of 2023 On Controlling Public Health Pest Control Pesticides Trading shall have the same meanings upon applying the provisions of this Regulation. Also, the following words shall have the meanings indicated opposite each thereof, unless the context requires otherwise. Public Health Pest Control Pesticides: Every substance or mixture of chemical, organic or biological substances, contains an active substance and another additive, and is used for the purpose of preventing, controlling, or reducing the spread of public health pests or regulating the growth thereof. Ready-To-Use Pesticides: Every substance, or mixture of chemical, biological, or organic materials, intended for controlling public health pests and prepared for direct use without the need for dilution or mixing by the end user, and its oral median lethal dose (LD₅₀) is 2000 mg/kg or above and through skin is 5000 mg/kg or above. Baits: A mixture of toxic pesticides and food or attractive substances, specially prepared to lure rats and other rodents to willingly eat it, resulting in their death due to the toxic effect of the active substance. Baits Stations: Boxes designed to secure the baits therein, protect them from the effects of climatic factors and prevent non-target organisms from reaching them. Activities: All works related to public health pest control pesticides trading, storing, transporting or using them in control works or disposing of their empty or damaged containers, in addition to advertise and promote them through various media, also include training activities, providing consultations and technical services related to the fields of trading these pesticides. Integrated Pest Control Principle: Use package of diverse and integrated methods and means, such as biological, behavioural, physical, design and construction mean, along with chemical pesticides, with the aim of controlling public health pests, in order to reduce depending on chemical pesticides, limit harmful environmental effects thereof, and decrease pests’ resistance thereto, without disrupting the effectiveness and efficiency of control operations. Pesticide Circulation: Non repetition of using the same pesticide or a similar one for a regular period longer than one month every three months throughout the year, or as recommended by the manufacturer on the pesticide container label or safety leaflet, for the purpose of reducing pests’ resistance to pesticides. Register: The manual or electronic register prepared to register and approve workers and establishments and whatever related to exercising the activity of public health pest control pesticides trading. Technical Cadres: Technical supervisors and workers enrolled in the register who are permitted to carry out control services and practise the activities. Article (2) Public Health Pest Control Establishments Classification The Division shall classify Public Health Pest Control Establishments in ascending order according to the following categories: First Category: Establishments licensed to practice public health pest control activity, except the following: 1. Preventive control of termites. 2. Pest control in grain and foodstuff warehouses using fumigation. Second Category: Establishments licensed to practice first category activities, in addition to one of the following two activities without combining the same: 1. Preventive control of termites. 2. Pest control in grain and foodstuff warehouses using fumigation. Special Category: Establishments licensed to practice all the activities referred thereto in the first and second categories together. The classification of the establishment category may be amended whenever it meets the approved requirements and standards of the targeted category. The establishment is prohibited from practicing any of the higher category activities before approving the new classification by the Division. Article (3) Public Health Pest Control Establishments Register 1. It is prohibited for any natural or legal person to practice public health pest control activities or carry out any work related thereto, unless being enrolled in the register and holding certificate in this regard from the competent division. 2. The application for enrollment in the register shall not be considered unless the following data and documents are completed: a. Approved operational chart of pesticides store. b. Accreditation certificates of technical cadres. c. Accreditation certificates of vehicles designated for pest control works. 3. The data enrolled in the register may be amended, either by adding warehouses, vehicles, technical cadres or deleting them, after paying the prescribed fee. 4. The Division shall issue a list of public health pest control establishments that have been enrolled in the register and this list shall be published on the Department's website. Article (4) Registration Term 1. Registration shall be for two years and the Division may renew the same for one term or more, provided that prescribed registration conditions shall continue to be met and payment of the fees. 2. The establishment should apply to the Division to renew registration thereof within the month that precedes the registration expiry date. 3. Failure to renew the establishment's registration by the specified deadline will result in its cancellation and all works related to the registered activity will be suspended as of the date of cancellation. 4. The establishment, whose registration had been canceled for not being renewed on time, may apply to the Division to renew the same within a period not exceeding six months from the date of cancellation, after paying the prescribed fee and delay fine stipulated in the approved fines schedule. If this period expires without submitting the application, then the registration shall not be reinstated except by following the procedures for registration for the first time. Article (5) General Conditions for Practicing the Activity The person wishing to enroll in the register to practice the activity must adhere to the following conditions: 1. Obtain valid license issued by the competent authority. 2. Provide technical supervisor certified by the Division to oversee implementing public health pest control processes. 3. Provide at least two technical workmen certified by the Division to practice the activity. 4. Commit to practicing the activity as per the establishment’s approved category. 5. Provide a warehouse approved by the Division and allocated for keeping the pesticides, machines and tools of public health pest control. 6. Provide one vehicle at least, approved by the Division to transfer public health pest control pesticides or equipment. 7. Commit to all approved conditions and controls of trading and using pesticides in the Estate. 8. Provide technical and logistical equipment, particularly devices, equipment and pesticides designated for implementing public health pest control processes. 9. Document activities in reports and records matching the forms approved by the Division. 10. A system for keeping records and documents related to the supply, sale of pesticides, and public health pest control shall be available for a period of no less than five years. 11. Obtain all approvals and permits required to practice the activity, according to procedures and electronic systems approved with the competent administration. 12. Pay the prescribed fees for the services and procedures necessary to complete registration and accreditation. Article (6) Conditions of Accrediting Technical Cadres for Public Health Pest Control It is required for certifying the technical cadre specialized in public health pest control and enrolling him in the register, the following: 1. The non-Emirati applicant is holding valid visit or residence visa within the State at the time of submitting the application. 2. Pass the technical cadre exam approved by the Division, for the category to which he applies to be registered therein. 3. The technical supervisor shall be from the technical cadres holding a university degree of bachelor's level in one of the scientific disciplines related to the field of pesticides and public health pest control, such as: agricultural sciences, public health, entomology, zoology, ecologies, or chemistry and he shall be literate in reading and writing in English. 4. The technical supervisor shall have at least eight years of practical experience within the State in the field of public health pest control, if he holds a scientific diploma in a related discipline or bachelor's degree in an unrelated discipline. 5. The remaining technical cadres shall have at least one year of practical experience within the State in the field of public health pest control. If practical experience within the State is not available, it may be substituted with a practical training certificate in the field, issued by a specialized training authority accredited by the Division. Article (7) Conditions of Accrediting Technical Cadres for Termites Control and Grain Warehouses Fumigation Without prejudice to the provisions of Article (6) of this Regulation, it is required for accrediting technical cadre to work in the field of termites preventive control upon constructing new buildings or in the field of public health pest control through fumigation of grain and foodstuff warehouses, that he has at least one year of practical experience within the State in the required field or holds a practical training certificate in the same field issued by a specialized and accredited training authority. Article (8) Technical Requirements of Pesticides and Equipment Warehouse It is required to enroll the place prepared to be public health pest control pesticides and equipment warehouse, that it must meet the following requirements: 1. The warehouse shall have a valid license issued by the competent authority to practice public health pest control activity or trade in pesticides thereof. 2. Obtain a valid environmental permit from Environment Protection and Development Authority in Ras Al Khaimah. 3. Submit a valid preventive safety certificate issued by Civil Defense. 4. Availability of valid contract for the proper disposal of empty or damaged pesticide containers, concluded with Public Services Department or private company accredited therewith. 5. The warehouse location shall not pose a risk to public health or surrounding environment. 6. The warehouse shall be in a location that is easily accessible for emergency vehicles. 7. The warehouse shall be located within a property classified in its title deed "commercial" or "commercial residential". 8. The property shall meet all the conditions and controls stipulated in the building requirements and specifications regulation applied in the Emirate. 9. The net area of the warehouse shall not be less than thirty square meters. 10. The walls and ceiling of the warehouse shall be completely free of any cracks or openings, and no material that allows light to penetrate should be used in construction or covering thereof. 11. The floors shall be completely free of cracks or openings and made of non-porous material that does not allow the absorption or penetration of pesticides, especially in cases of accidental spill. 12. Floors, walls, ceiling and shelves thereof shall be made of materials that are resistant to chemical agents and easy to clean. 13. The warehouse’s components shall not contain the asbestos or any environmentally prohibited substance. 14. Provide the warehouse with one ventilation fan at least for each thirty square meters. 15. Provide artificial lighting system with capacity not less than (500 Lux). 16. Install an air conditioning system that maintains an indoor temperature not exceeding twenty eight Celsius degrees. 17. The warehouse shall be provided with a sink designated for washing hands and equipment connected to constant water source. 18. The warehouse shall be equipped with at least two fire extinguishers, one is foam type and the other is carbon dioxide type. 19. Provide the warehouse with first aid kit in a visible and easily accessible place. 20. The warehouse shall be provided with shelves or cabinets or holders dedicated for storing pesticides and public health pest control equipment along with prohibition of using wood or any material that may react with pesticides. 21. Availability of necessary materials and equipment in the warehouse to address leaks and spills. 22. Install a permanent sign board at the entrance of the warehouse, displaying the commercial name of the establishment and the phrase 'Pesticide Warehouse' in both Arabic and English. 23. Install a board of emergency numbers in visible place inside the warehouse, including the police, ambulance and civil defense numbers, clearly written in both Arabic and English. 24. Provide detailed chart prepared by a licensed engineering consulting office within the Emirate, outlining all the components of the warehouse according to the conditions stated in this article and the same shall be approved by the competent administration and shall be considered as a reference for preparing the warehouse on the ground. Article (9) Technical Requirements of Pest Control Pesticides and Equipment Transport Vehicles The following technical requirements should be met in order to enroll public health pest control pesticides and equipment transport vehicle in the register: 1. It has valid license. 2. The establishment's logo and trade name shall be fixed on both sides of the vehicle in a visible and clear manner, accompanied by the phrase "Pest Control" or " Pesticides" and such details shall be written in Arabic and English in a clear font that allows easy verification thereof during moving or stop. 3. The vehicle shall be equipped with tank or box designated for loading pesticides and public health pest control equipment, with an appropriate storage capacity, separate from the passenger compartment, securely closed on all sides, and resistant to leakage and heat. 4. The vehicle shall be equipped with usable first aid kit that complies with approved medical requirements. 5. The vehicle shall be equipped with an effective cooling method that ensures maintaining pesticides at a temperature not exceeding twenty-eight Celsius degrees. 6. Any other technical requirements necessitated by the nature of vehicle use and shall be specified by a decision from Administration Director, based on a proposal from the Division. The administration shall coordinate with the authority responsible for vehicle licensing regarding the mechanism for verifying the availability of technical requirements before issuing the license. Article (10) Technical Requirements for Companies Conducting Training On Pest Control & Pesticide Trading Activity It is required to approve training facilities for the activity of handling public health pest control pesticides by the Division, that the following technical requirements shall be met: 1. The establishment shall have a valid license to practice the activity, issued by the competent authority in the Emirate. 2. The establishment licensed to practice the activities outside the Emirate holds prior permit from the competent authority, in addition to permit from the Director General 3. Availability of trainer with at least bachelor's degree in one of the scientific disciplines related to the activity, with at least two years of practical experience in the field of training, provided that the qualification issued by foreign educational institutions shall be accredited by the official authorities in the State and the trainer must pass the approved technical test for the training cadre. 4. Availability of the material of the theoretical and practical training program, along with the means to evaluate the performance of the trainees. Article (11) Technical Requirements for Implementing Pest Control Service The establishments and technical cadres should, upon implementing the service, adhere to the following technical requirements: 1. Apply the principle of integrated control of public health pests in all executed processes. 2. Use pesticides that are registered with the Federal Authority and not using any banned, expired or damaged pesticides. 3. Use pesticides according to the recommendations and information set out in the pesticides labeling and the safety leaflet approved by the Federal Authority. 4. The Cadre shall wear the uniform designated by the establishment which bears its logo and trade name, during implementation of field processes. 5. Use personal protective equipment during implementation of control processes, according to the recommendations outlined in the safety leaflet of the used pesticide. 6. Recycle pesticides and document recycling processes within monthly reports, according to the forms approved by the Division. 7. Comply with the requirements of control processes implementation reports forms and contracts concluded in respect thereof. 8. Consider public health and safety and environment protection precautions. 9. Secure baits stations and traps and close them tightly; to prevent children and non-target organisms from reaching them. 10. Place the necessary warning labels in processes sites and on equipment to alert against the dangers of pesticides and toxicity thereof. 11. Take all necessary precautions to protect non-target organisms during pest control processes. 12. Obtain the necessary permits from the Division before carrying out any of the following processes: a. Fumigation processes in grain and foodstuff warehouses. b. Preventive control of termites upon constructing new buildings. c. Animal parasites control in farms, barns and livestock markets. 13. Implement corrective procedures and address the observations stated in the Division's records or periodic inspection reports issued thereby. 14. Set, maintain and update a system for saving and documenting records of public health pest control pesticides trading activities, in accordance with the approved forms with the Division. 15. Availability of valid occupational health certificates for all labors in public health pest control pesticides trading chain. 16. Equip pesticide spraying devices with a digital meter that shows the quantity of pesticide consumed after preparation, during the preventive processes of termites control while constructing buildings. 17. Use pesticides specifically intended for termites’ preventive control according to the instructions of the approved label. 18. Commit to using the equipment and facilities of fumigation processes including mobile gas containment chamber, gas meter and personal protective equipment for cadres. 19. Document all phases of public health pest control processes and sites thereof by recording clear and dated video clips, which shall be kept in the establishment's pest control records. These clips must visibly and clearly include the following elements: a. Identification board of implementation site. b. Types of used pesticides along with original containers displayed in clear way. c. Prepared quantities of pesticides before usage and the remaining quantities after process completion. d. Readings of termites control devices, at the beginning and end of operation. Article (12) Requirements of Trading, Maintaining, Transporting and Storing Pesticides First: Upon trading public health pest control pesticides, it is required to comply with the following requirements: 1. Trading shall be inside the warehouses using vehicles approved by the Division. 2. Keep the pesticides in temperature not exceeding twenty-eight Celsius degrees. 3. Not to leave pesticides, at any stage of trading, without effective securing and supervision. 4. The storage capacity of the warehouse shall match the stored quantities of pesticides and equipment, ensuring that there are pathways no less than one meter wide and that pesticide containers are separated from the equipment by suitable distances. 5. Proper disposal of damaged pesticides and empty pesticides containers under contract concluded with Public Services Department. 6. The release of pesticide shipments, including ready-to-use pesticides and the raw materials used in formulation thereof, through the State's land, sea and air gates, in accordance with the systems approved by the competent Federal Authority. 7. Keep copies of pesticide registration certificates, identification labels and safety leaflets approved by the competent Federal Authority in the pesticide warehouse and transport vehicles. 8. Availability of accurate data in respect of pesticides supply and sales and document such data in monthly reports, according to the forms approved by the Competent Authority. 9. Dilute pesticides or mix them in the necessary amounts for treatment purposes, while strictly adhering to the approved usage instructions. 10. Availability of the original pesticide container at the workplace during dilution or mixing processes. Second: It is prohibited, when transporting, trading, storing, or using public health pest control pesticides, to commit any of the following acts: 1. Store pesticides after dilution or use them after elapsing more than six hours after the completion of dilution process. 2. Mix two types or more of pesticides or mix the same with substances not approved by the Competent Authority. 3. Re-fill any pesticide in container other than its original one. 4. Remove or damage the identification label pasted on the pesticide container or tamper with the data stated thereon. 5. Advertise or promote trading pesticides through any media without prior permit from the Competent Authority. 6. Trade pesticides in their concentrated form that are not intended for direct use, or classified as 'highly toxic', except through establishments licensed to engage in the trade of public health pest control pesticides. 7. Deal with pesticides in their concentrated form or classified as 'highly toxic' with non-specialized authorities, or with technicians not accredited by the Competent Authority. Article (13) Mandatory Details of Pest Control Service Report Form It is required to approve public health pest control service implementation report form, that it includes accurately the following details and information: 1. The trade name of the establishment implementing the service. 2. Name and address of the Authority receiving the service. 3. Date of implementing service processes. 4. Time in which the work team entered and left the service site. 5. Name and contact information of technical supervisor who is responsible for implementing the service. 6. Names and phone numbers of technical team participating in the service. 7. Area of the site where service is implemented, along with detailed description of its internal sections and their uses or attach a simplified chart illustrating that. 8. Climatic information in the environment surrounding the service site (temperature, humidity and wind speed). 9. Health and occupational safety risks of service site. 10. The results of inspection and preliminary investigation on any signs or indicators of presence of pests in service site. 11. Detailed statement of the targeted public health pests and specify their locations within the site. 12. List of names of used pesticides, their quantities and locations of use thereof on the site. 13. Type and number of equipment and devices used in the service. 14. The number of traps placed within the site, along with specifying locations of their distribution. 15. Non-chemical control methods that have been followed. 16. The factors or environmental conditions that contribute to attracting pests or harboring them at the site and recommendations for preventive maintenance to minimize them. 17. Details of communicating with the representative of the service-receiving authority related to identifying the types of pests, proposed control options, prevention procedures and number of follow-up visits and dates thereof. 18. Identify the locations that are likely to serve as a habitat for pests on the site, which could not be inspected or treated, along with stating the reasons for that. 19. Document all service implementation steps, places where it is implemented, as well the pesticides and equipment used, through clear and dated photographs and video clips. 20. Signature of technical supervisor on the report. 21. Signature of the representative of the authority benefiting from the service. Article (14) Pest Control Service Contract Form Requirements It is required, for the approval on public health pest control service contract form with the Division, that it includes the following. 1. The trade name and trade license of public health pests control establishment. 2. The name of the authority benefiting from the service and its trade license number - if any. 3. State the contract start date and end date, provided that its term shall not be less than one Gregorian year. 4. The commitment of the establishment to inform the representative of the beneficiary authority about the results of the inspection and investigation and state the possible control options, as well as suggest the number of visits required to implement and follow up the service periodically, in accordance with the nature of the activity, subject matter of the service, in addition to recommending the necessary maintenance works to ensure the effectiveness and sustainability of the control process. 5. State the expected dates to conduct inspection and periodical follow-up visits, specify the number of each during the contract term, provided that number of follow-up visits shall not be less than one visit per month for foodstuff establishments and one visit every two months for non-foodstuff establishments. 6. Commitment of the establishment to respond to requests for emergency visits, to implement the service within twenty-four hours from the date of receiving the request. 7. The commitment of the beneficiary authority to implement the recommendations stated in control report in respect of cleaning works and maintenance and remove environmental conditions which contribute to attracting pests or reproduction thereof. 8. The commitment of the establishment to deliver a copy of the report on the implementation of the control processes to the beneficiary authority immediately upon completion. 9. Authenticate the contract with the Competent Authority. 10. Attest the name and signature of both parties to the contract, indicating their awareness and acceptance of all conditions, and their full commitment thereto. 11. Any other technical requirements issued by a decision from the Director of the Administration and published on the Department's website. Article (15) Requirements of Approving Pesticides Supply and Sale Monthly Report Form It is required to approve the monthly report form of public health pest control pesticides supply and sale in the competent division that it must include the following data: 1. Number of the trade license issued for public health pest control pesticides trading establishment. 2. Trade name of public health pest control pesticides trading establishment. 3. Detailed statement of names of the pesticides supplied to the warehouse during the report period, including quantity of each pesticide in liter or gram, date of supply and name of supplying authority. 4. Detailed statement of names of the pesticides sold from the warehouse during the report period, including quantity of each pesticide in appropriate unit “liter or gram”, date of sale and name of authority to which sale was made. 5. Date of preparing the report, name of the establishment’s representative who prepared it and his signature. Article (16) Requirements of Logistical Equipment to Practice Control Activity It is required, to practice the activity of pest control, that the licensed authority has the following logistical equipment: 1. Inspection and investigation devices for public health pests, specifically: a flashlight with an intensity of at least three thousand lumens, a magnifying lens with a magnification of no less than five times, substances specifically designed to attract public health pests, a high-resolution digital camera, containers for collecting insect samples and their development stages, nets for collecting mosquito larvae, non-toxic baits and traps for monitoring. 2. Personal protective equipment, including: gloves, eye and respiratory system protection devices, safety shoes, protective suit and head cover. 3. Equipment for opening manhole covers, including: hammers, dedicated keys and bait stay wires. 4. Control equipment, including pumps, spraying and fumigation devices, pesticide preparation and dilution equipment, bait stations, physical, pheromone, light, carbon and glue traps and rodent traps and pesticides specific to each type of targeted pests. 5. Equipment for absorbing accidentally spilled pesticides. Article (17) Public Health Pest Control Pesticides Trading Activity Advertising Permit Requirements It is required to obtain a permit from the Division for promotional advertisement through media for pesticide trading, meeting the following requirements: 1. Obtain a valid license to practice advertising activities, issued by the Competent Authority. 2. Obtain a license for designing and producing advertisements, issued by the Competent Federal or Local Authority. 3. Provide the safety leaflet and labeling for the pesticide to be promoted, as well as its registration certificate with the Federal Authority. 4. Provide the complete content of the promotional advertisement, including audio and visual materials and written texts to approve it in advance by the Division. 5. Pay the prescribed fees. Article (18) Requirements for Keeping and documenting Pesticides Trading Activities Records Establishments licensed to trade public health pest control pesticides must provide an effective system for keeping and documenting records of their activity, provided that it shall include the following documents: 1. Establishment registration certificate in the register of public health pest control establishments. 2. Service reports on implementation of control processes. 3. Photographs and videos that document pest control processes. 4. Copies of contracts concluded with the authorities benefiting from the service. 5. Pesticide registration certificates with Federal Authority. 6. Approved identification labels and safety leaflets. 7. Pesticides recycling processes reports. 8. Accreditation certificates for supervisors and specialized technical workforce for pest control processes. 9. Certified occupational health certificates for workers in pesticide trading activities. 10. Pesticides transport vehicles certifications. 11. The approved detailed chart of pesticide warehouse. 12. Civil Defense permits and valid environmental permits. 13. A permit to conduct activities issued by the Competent Authority and the permit issued by the Director General, for establishments licensed to operate from outside the emirate. 14. Pesticides supply and sale monthly reports. 15. Reports on the proper disposal of damaged pesticides and empty containers thereof. 16. Promotion and advertising permits for pesticides trading when conducting promotional activities. 17. The annual record of inspection visits to the establishment. Article (19) Notices Notices shall be addressed from the Division to the establishments using one of the following means: 1. Express mail or electronic mail registered with the Department. 2. Short text messages, or technology applications approved by the Department. 3. Publish on the website of the Department. 4. Any other means approved by the Director General through a decision published on the Department's website. Article (20) Set Up Seized Items Sale Committee When setting up the committee specializing in disposal of seized materials, machines and tools, the nature of the tasks assigned thereto shall be taken into consideration, along with availability of necessary legal and technical expertise among members thereof. The Committee shall issue its decisions by a majority of its members' votes, and one of the Division's employees shall hold the position of Secretary. The Committee may hold its meetings remotely using modern technology means. The Committee may, when necessary, seek assistance from those it deems suitable with expertise or specialization and may undertake the procedures of disposing of the seized items or carry out the same in collaboration with other authorities or assign them to a licensed authority. Article (21) Committee Work Mechanism The Committee shall undertake its tasks as follows: 1. Inspect the seized items and estimate their value based on the prevailing prices at the time of the inspection. 2. Prepare detailed lists that include descriptions of the seized items, their estimated values and fees, expenses and fines due thereon. 3. Verify the legal status of the seized items and take the necessary actions to dispose thereof through sale in public auction. 4. Any other tasks required by the nature of the Committee's work assigned thereto by the Director General. Article (22) Exception From Bidding Procedures Notwithstanding the provisions of Article (21) of this Regulation, the Committee may directly dispose of the seized items by selling them to the highest bidder among three purchase offers it receives, in the following cases: a. If the seized items are subject to damage, destruction, spillage or loss by nature or due to the passage of time. b. If the costs of maintaining or storage thereof exceed their estimated value. c. If no one comes forward to bid thereon, despite the announcement. In case the sale of the seized items is not possible or if they are among the items whose trade or disposal is prohibited, the Committee shall issue a decision for their proper disposal at the expense of the violator. Article (23) Repeal Each provision in a resolution contradicts with provisions of this Regulation shall be repealed. Article (24) Regulation Enforcement This Regulation shall come into force from promulgation date thereof and be published in the Official Gazette Mohammed Bin Saud Bin Saqr Al Qasimi Crown Prince of Ras Al Khaimah & Chairman of the Executive Council Promulgated by us on this day eighth of Rabie Al Akher 1447H.
