Law No. 4 of 2020 Regarding Traffic Tariff in Emirate of Ras Al Khaimah We, Saud Bin Saqr Bin Mohamed Al Qasimi - Ruler of Ras Al Khaimah After perusal of the Constitution; And Federal Law No. 12 of 1976 on Police & Security Force, as amended; And Federal Law No. 3 of 1987 on issuing Penal Code, as amended; And Federal Law No. 35 of 1992 on issuing Criminal Procedures Code, as amended; And after the approval of the Executive Council; Have promulgated the following Act: Article (1) The following words and phrases shall have the meanings corresponding to each of them respectively, unless context otherwise stipulates: Emirate: Emirate of Ras Al Khaimah. Ruler: Ruler of the Emirate. Executive Council: Executive Council of the Emirate. Department: Public Services Department in the Emirate. President: President of Department Director-General: Director-General of Department Toll Card: It is a technical means fixed in the vehicle that contains data which enable Toll Gates to collect the determined tariff. Toll Gates: Technical devices installed in specific locations to collect traffic tariff through the card fixed in the vehicle upon passing such locations. Aber System: Toll Electronic System in which vehicles are registered in order to pass through toll gates, and manage the accounts of their users. Vehicle: A mechanic machine runs on the road by mechanical power or any other means and includes truck. Article (2) A traffic tariff may be imposed on vehicles when passing toll gates in the Emirate. A resolution to determine roads and vehicles subject to the fee and value thereof shall be issued by The President of the Department and approved by the Ruler or his representative. Article (3) Director- General shall approve controls and schemes of locations in which toll gates shall be established and technical specifications thereof in accordance with traffic and traffic safety of users of roads in the Emirate, in coordination with RAK Police General Headquarters. Article (4) Before passing toll gates, owner of the vehicle must register in Aber System through the Department or approved means and authorities such as websites, smart applications and sales and collection outlets. Article (5) Traffic tariff shall be collected by deduction from the available account balance in toll card of the vehicle, subject to the following: 1- Grant owner of vehicle not registered in Aber System a grace period of ten days starting from the date of passing the toll gate for the first time to register in the System and get toll card. 1- Grant owner of vehicle who does not have sufficient balance in his account in the System a grace period of seven days starting from the date of passing through the toll gate to add balance to his account. And in case the mentioned two grace periods elapsed without registering in the System or adding balance, the vehicle’s owner shall be deemed evader from paying the traffic tariff. Article (6) Vehicle’s owner shall commit to the following: 1. Fix traffic tariff card in the place designated thereto in the vehicle. 2. Keep the plates of vehicle clear to ensure correct reading thereof by the System. 3. Update vehicle’s data upon any change thereupon within one week from the date of the change. Article (7) The following vehicles shall be excepted from implementing the provisions of this law: 1- Vehicles of armed forces which carry the numbers and plates thereof. 2- Vehicles of police, civil defense and ambulance which carry the logo thereof. 3- Vehicles designated to transfer students of schools or educational institutions or universities. 4- Vehicles licensed for care of people of determination as well as vehicles designated to be used by them 5- Vehicles exempted by resolution from the President Article (8) By resolution from the Department’s President, schedules of fees, violations and fines resulting from violating the provisions of this law, shall be issued and approved by the Ruler or his representative and proceeds of these fees and fines shall devolve upon the treasury of the Department. Article (9) Employees of Control Unit in the Department shall have the capacity of law officers to seize acts committed in violation of the provisions of this law. Article (10) In order to implement provisions of this law and its executive regulation, the Department is entitled to seek the assistance of government authorities. public authorities and establishments and RAK Police GHQ. Article (11) The Committee, formed according to the provision of article 18 of Law no. 3 of 2017 on establishing Public Services Department, shall have the competency to consider complaints and grieves arising from implementation of provisions of this law. Article (12) The Executive Council shall issue the executive regulation of this law based on proposal of the Department. Article (13) Any other provision that contradicts with provisions of this law shall be cancelled. Article (14) This Act shall come into force as date of its issuance and be published in the Official Gazette.
